III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. <br />Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the <br />enforcement action. <br />Availability of Records <br />Records were inspected and found to be current with two exceptions. The pond and waste pile <br />inspection reports for the 1st quarter of 1997 were not available. The operator indicated he had <br />spoken to the inspecting engineer about the reports, and that they would be available at the mine by <br />the end of the week. A copy of the reports should be forwarded to CDMG no later than July 2, 1997. <br />Documentation of inspected records is attached. <br />Signs and Markers <br />Mine identification signs were in place as required, as were topsoil stockpile markers and permit <br />boundary markers. The sign for Topsoil stockpile No. 1 still needs to be moved so that it is obvious <br />that recently moved material is also topsoil. Permit boundary markers need to be installed on the <br />northern side of the eastern portion of the loadout, where they were removed for reclamation. <br />Hydrologic Balance <br />All sedimentation and freshwater holding ponds held water, with the exception of the loadout ponds. <br />None of the ponds holding water were discharging. <br />The explosives storage area sediment control had been recently maintained. All drainage from the <br />bunker pad is treated by straw bales on the north end of the pad. Drainage off of the light use road to <br />the pad is treated by a silt fence where the road intersects the county road. Three water bar dips have <br />been graded into the road to prevent gullies from forming, and to control sedimentation from the <br />Newlin Creek site. <br />The loadout area drainage and sediment control structures were in good condition, having been <br />recently maintained. The culverts were clear and silt fences were functional. A recent rainstorm <br />caused heavy damage to adjacent structures associated with the county road, but structures at the <br />loadout appeared to have functioned properly. <br />The Monarch fan site silt fence was well maintained. It did not appear that there had been any recent <br />flows through the silt fence. <br />The rock dust storage area silt fence needed to be maintained. A small hole has opened at the base <br />of the fence. It was not evident that excess sediment had left the disturbed area as a result of the <br />hole, but the fence should be replaced immediately to avoid offsite damage. <br />The Magpie Creek diversion channel was stable and in good condition. <br />Maintenance was needed on the ditch along the north side of the facilities yard (Collection Ditch No. 1) <br />and at the culvert which carries water under the truck scale/truck loading chute road. Sediment has <br />accumulated in the ditch and in front of the culvert. <br />C-81-014 6-25-97 <br />
