aI <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />The contractor is continuing the construction work at the train loadout. The main line~has been <br />relocated just to the north of the old location. Two small seeps developed in the cut slope <br />between the track and old highway 133. The two seeps have caused two small slumps in the cut <br />slope. The water is thought to be coming from leaks in the Fire Mountain Canal, which is just <br />above the road. Bowie repaired that section of the canal and the seep flow was greatly reduced. <br />However, a small flow remains. The operator is considering diverting the seep flow under the <br />tracks and away from the disturbed azea: <br />Cut and fill operations aze in progress for the spur line track bed. The cut operations in the <br />eastern portion of the bench aze providing the fill for the bench in the western portion. Shortly, <br />the railroad will start construction of the 2 spur lines, starting in the east and moving to the west. <br />The contractor is still working on the field erection of the transfer tower, conveyor sections and <br />loadout bin. The containment berm around the contractor's fuel tank at the train loadout <br />construction site was heightened. Bowie is expecting all construction work associated with the <br />train loadout to be finished in about 6 weeks. <br />Gob Pile <br />The operator has constructed a new road segment over the second lift. The outslope of the <br />second lift has been covered in soil. The gob pile has positive drainage and the underdrain has <br />been left exposed in the back of the gob pile. Collection and diversion ditches are functional, <br />although the west collection ditch could use better definition. The culvert and water baz at the <br />entrance to the gob pile were functional. <br />HydroloQy <br />There was only a little water in Pond B but the water level in Pond C was just above the primary. <br />Pond D was dry. The operator cleaned out a lazge section of Pond C. The operator is planning on <br />cleaning out the other ponds as well. Pond D needs a cleaning out soon. <br />The two new ponds at the train loadout have been completed. Both ponds were dry. The <br />outslopes of the south embankment and west embankment of Pond K were reworked to get a <br />3H: I V slope and one section of the south embankment inslope was reworked to get the 2H:1 V' <br />slope, compatible with the pond designs. During the inslope reworking work on Pond K, some <br />dirt was lefr next to the primary tube inlet. It would be a good idea to remove this dirt. <br />
