2 <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bi1LBeaz <br />represented the operator. <br />Roads <br />The paved haul road up to the portal bench was in excellent condition, with the guardrail in <br />place. The haul road to the gob pile was-also n good condition. The road berm on the outer edge <br />of the gob pile haul road was functional. The access road up to the water tank bench was also in <br />good condition. <br />Sims and Markers <br />Mine ID signs were up at the appropriate locations and contained the correct information. <br />Surface disturbance mazkers were up around the mine site, although not all of the mazkers are up <br />at the train loadout under construction. <br />To soil <br />There were no erosional problems at the topsoil stockpile at the main mine site. The collection <br />and diversion ditches were functional. The straw bales were in place in the berm notch at the low <br />point of the stockpile. The topsoil sign was up. <br />There were no problems at the -gob pile topsoil stockpile and the coverfill topsoil stockpile, both <br />located at the main mine. Straw bales were in place and topsoil signs were up. <br />The topsoil stockpile at the train loadout is still expanding. There is a temporary sediment control <br />berm and ditch in place. When the pile is completed, a containment berm and straw bales or silt <br />fence will be constructed. The topsoil stockpile sign was up. <br />Facilities <br />The longwall has been moved and mining of the new panel has begun. The coal stockpile <br />adjacent to old highway 133 is moderate in size. The coal stockpile on the portal bench is <br />somewhat small in size. The operator is watering down the entrance area to the coal haul truck <br />loading azea. There were no problems with fugitive dust <br />
