IV. ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required abatement <br />and date of abatement for the violation, previous violations still requiring abatement and the <br />termination of violations cited Burin revious fns ections. <br /> ood condition <br />Coyote Dry. No significant gullying was noted. <br />Explosives: The old explosives area has been graded, pole barn and fencing removed. TMI plans to topsoil <br />and seed this area this construction season. <br />To soil: The operator was salvaging topsoil at the southeast extent of Pit F. Soil is moist but not wet so <br />salvage is appropriate. TMI is approved to salvage topsoil south of the ridgeline. Steepness of this oak brush <br />covered slope make topsoil salvage dangerous to the equipment operators. TMI has adequate topsoil <br />salvaged in other areas. The inability to salvage topsoil in this limited south facing slope area should not <br />affect the ability to replace the required topsoil depth. Topsoil piles through out mine site had Topsoil <br />markers, were well vegetated and no sign of weeds yet this yeaz. Accessibility to topsoil piles neaz ponds <br />proposed as permanent in TR-94 was assessed. Many of these piles aze adjacent to roadways and potentially <br />could be utilized in other reclaim areas in the future. <br />Fish and wildlife:. Pronghorn antelope were plentiful throughout the mine site. Elk and an occasional <br />mule deer were noted along the northern and southern permit azeas. Raptors noted mostly on the western <br />side of the mine. An immature Golden eagle, and an immature Bald eagle were noted neaz the Far East <br />Buzzard pond. A pair of Swainsons hawks were observed near the West Buzzard drainage. And a pair of <br />Feruginous hawks were nesting on a power pole at the southwest extent of reclamation adjacent to the Eagle <br />Mine Complex permit boundary. <br />Reclamation success: SL06 remains under review by DMG. Incorporation of a description of the shrub <br />study plots is needed from the operator. Areas included in the "year nine" sampling vegetation monitoring <br />report submitted to the Division by TMI in 2005 were inspected. Many of the plants were still dormant due <br />to the eazliness of the growing season. Most of the azeas included in the monitoring area appeaz in fair <br />condition. Some areas appear to have a fair amount of annuals though observation throughout the growing <br />season may show otherwise. The Cropland reference area still appears patchy. Some areas appeaz to have <br />good stands of alfalfa and grasses, while other parts of this reference area appeaz dominated by annuals. <br />TMI discussed future permitting plans. Reconfiguration of G strike pit is expected.
