III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one <br />represented the operator during the field inspection. <br />West Mine <br />The as-built certification dimensions for the new ponds W-1 and W-2 at the west mine <br />reclaimed portal bench were checked in the field. The DMG used a straight stick and a <br />protractor to detemune dimensions. Because of the inherent inaccuracies of the <br />measuring technique, only approximations were expected. The valve on the primazy <br />dischazge tube of Pond W-1, the lower pond, was in the open position and should be <br />closed. The primary tube valve on Pond W-2 was in the closed position but the fit could <br />be better. This valve should be worked on a little more. There was a little water and ice in <br />both ponds. The silt fence below Pond W-I needs some repair and extended laterally a <br />little more. <br />At the west mine fan area, there has been a little more settling over the backfilled vent <br />shaft. Construction fencing was around the vent shaft area. The gate to the fan site was <br />open and the mine ID sign was up. Some of the silt fence will need repair soon. <br />
