The following problems (PB) and/or possible violations (PV) (and suggested corrective actions) were identified during this
inspection. The problems should be corrected by the dates given, or they will become possible violations. The possible
violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation
Board. The inspector noted on the previous page should be notified of all corrective actions taken.
PROBLEMS/POSSIBLE VIOLATIONS
AND
1. The permit file is unclear regarding the permitted acreage and the total surface area
of lake surface to be created during final reclamation.
CORRECTIVE ACTION: Submit a permit modification on or before March 31, 2003
which clarifies the total acreage to be permitted and the total acreage of lake surface
to be created during final reclamation.
2. The existing financial warranty of $37,800 is insufficient to complete the reclamation
plan for existing disturbances at the Durham-Pit 117.
CORRECTIVE ACTION: Submit on or before March 31, 2003 a replacement financial
warranty of $300,000 or an additional financial warranty of $262,200, and a permit
modification which includes a current map of existing disturbances, an accurate assessment
of all disturbances on site, and a detailed reclamation cost estimate based on such disturbances.
The assessment of existing disturbances should include the acreage of water surfaces;
acreage of active pit excavation; acreage of minor pit disturbance; acreage of plant, processing,
stockpile areas; volume of stockpiled topsoil; volume of stockpiled overburden; volume of
stockpiled broken concrete; acreage of concrete plant; inventory of all fuel tanks, concrete pads,
paved surfaces, buildings, or other structures; acreage of miscellaneous disturbances;
acreage of access roads; depth and linear feet of unreclaimed lake shoreline; depth and
linear feet of unreclaimed pit walls; acreage of affected land to be topsoiled; and
acreage of land to be revegetated.

3. The operator was conducting de-watering and dry mining operations with off-site discharge March 31, 2003
of mine waters. The mine plan specifies wet mining methods with no off-site discharge.
This is a possible violation of Section 34-32.5-116(1) of the Colorado Land Reclamation Act
for the Extraction of Construction Materials for failure to perform the reclamation prescribed
by the reclamation plan.
CORRECTIVE ACTION: Submit on or before March 31, 2003 a permit modification which PB or PV: PV
allows for pit de-watering and dry mining methods; or cease all de-watering and dry mining TOPIC(S): MP,HB
activities at the Durham-Pit 117 and provide photographic, written, or other evidence
verifying cessation of de-watering and dry mining activities.
4. There was no entrance sign as required by Rule 3.1.12. February 28, 2003
CORRECTIVE ACTION: Post an entrance sign in conformance with Rule 3.1.12 PB or PV: PB
and submit photographic or other evidence of completing this requirement on or TOPIC(S): SM
before February 28, 2003.
