On behalf of the Moffat County Road Department, I will respond to some of the discussions therein. t/1). Tuttle Pit: Written verification ofpermission to leave timber along the easterly edge of the permitted area. I have enclosed a copy of Exhibit E-5 showing the tree storage azea in our original reclamation pernrit application dated 12/28/41. Mr. Tuttle asked me to provide storage for firewood so his sheep herders could use it. Since he requested the firewood area, and he was notified by certified mail of the permit application on file in the Courthouse, and he was notified by repeated Public Notices published in the local paper, I do not believe it is necessary to trouble him for a written verification of this provision; he is not in good health. 2). Powderwash Pit #66: Culvert across the ephemeral drainage. Moffat County's legal .access to the Powderwash Pit is County Road #66, which runs north and south in the western 1/3 of the permitted azea. The only access to the eastern portion of our permit requires transportation across the drainage, whether it is a grade crossing, amined-out gravel pit, a culvert, or all of the above. The installation of any kind of crossing facility on this draw does not change the Mining Plan or the Mining Plan Map. I have enclosed Exhibit C-3 and Exhibit D, which state specifically that Moffat County intends to mine gravel on both sides of the draw, and we leave open the options of mining across the draw, or developing a culvert crossing (if necessary) under the Corps of Engineers' 404 Permit Rules. The DMG Rules and Regulations clearly recommend that the applicant leave room for flexibility in the Mining Plan and Reclamation Plan.
