III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments Include discussion.of observations made <br />during the inspection: Comments glso describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />The outside slope of the gob pile haul road was seeded and mulched. The silt fence at the base of the outslope <br />was functional, although a few silt fence panels will need some maintenance soon. The graveled gob pile haul <br />road was in good condition. The road berm and ditch were functional. <br />The operator is preparing to dewater Pond C so that the sediment can be cleaned out. Pond B was just cleaned <br />out. Pond D does not need to be cleaned out yet. Pond embankments and inslopes were stable and pond <br />spillways were functional. The old State Highway ] 33 road ditch that receives dischazge water from Pond C <br />and Pond D will need some cleaning soon. The straw bales and graveled pazking azea at the pump house were in <br />place. <br />The operator is working on the third lift of gob pile #1. The top of the pile had positive drainage and the <br />underdrain was exposed at the back of the pile, as designed. Diversion and collection ditches had sufficient <br />capacity. <br />The operator has begun construction of the gob pile #2 azea. This site will contain the new gob pile, a coverfill <br />(excess subsoil) stockpile, Pond F and one new and two expanded topsoil stockpiles. The operator has already <br />cleaned out the central portion of the gob pile area and installed an underdrain. Pond F is done except for some <br />last minute touch ups. Topsoil and coverfill stockpiles still need to be seeded and mulched. <br />Unit Train Loadout <br />There was no fugitive dust under the totally contained conveyor belt system down to the loadout bin. There was <br />a good cover of vegetation in this area. Some of the silt fence panels will need some repair soon however. <br />The vegetative cover on the outslope of the train track bench is very good. No erosional problems were <br />observed. In the west side track azea, irrigation water in the above field is flowing through the railroad track <br />culvert, as designed. A loaded unit train was pazked on site and no problems with fugitive dust were observed. <br />The sediment control system at the unit train loadout was functional. Culverts, ditches and berrrrs were all <br />functional. Both Pond J and Pond K were dry. There was coal dust on the bottom of Pond K from the wash <br />down of the loadout facility. The pond embankments were stable and the pond spillways were functional. <br />Freeman Gulch <br />The operator has. Sealed the Freeman Gulch vent sha$ with a concrete plug. The plug was not covered with dirt <br />yet. A large quantity of river gravel and dirt is still on site. It was to be used to fill up the vent shaft but turtied <br />out to be excess. Tlie pad azea was very well vegetated. The road to the site was in good condition.
