I_~. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />during the inspection: Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado Division of Minerals and Geology. <br />Bill Bear represented the operator during the field inspection and records check. <br />Main Mine Site <br />The paved haul road at the main mine site was in very good condition. The operator had just finished digging up <br />the road in two places, one for the installation of a water line to the wash plant and the other for removal of a <br />culvert. Mine ID signs and surface disturbance markers were up. \ _ <br />There have not been any rockfalls into the recently constmcted rock catchment berm above the water tank <br />bench. The berm is holding up well. However, the operator needs to cover up the fabric on the south facing side <br />of the berm, so that ultraviolet light does not degrade the material. This should be done soon. In addition, the <br />operator has installed a sign along the side of the dirt road neaz the berm that warns of potential subsidence- <br />induced hazards. <br />There were no problems noted on the water tank bench. However, the back ditch could use a little cleaning soon. <br />No problems were observed at the D-seam portal bench either. The culverts behind the coal stockpile were clear. <br />The coal stockpile was small in size and did not encroach on the undisturbed land. No fuel leaks were observed <br />at the fuel barn. To the east of the portal bench, the material storage areas were well organized and the cap and <br />powder houses were locked. <br />The operator continues to do facilities construction work on the B-seam portal bench. The mains for the B-seam <br />are being driven now.-The ditch below the B-seam excess material storage site is being concreted. Culverts and <br />road ditches along the haul road were all functional. No signs of slope instability were observed. Outslopes were <br />well vegetated. <br />The operator did some maintenance work on the ditch berm on the west side of the main Yopsoil stockpile. The <br />sediment control system ofberms and straw bales on the topsoil stockpile was functional. The vegetation on the <br />topsoil stockpile is very good, except where new topsoil was recently placed. The vegetation on the south facing <br />slope of the topsoil stockpile is starting show signs of drying out. The material storage area next to the topsoil <br />stockpile was well organized. . <br />Work is fuushed on tha new reclaim system at the coal stockpile bench. The operator seeded and mulched a <br />portion of the outside slope of the coal stockpile bench that had been disturbed by the construction. There was a <br />large amount of coal stockpiled on this bench. The coal was right up to the containment berm. There were no <br />problems with .fugitive dust. The old State Highway 133 road ditch in front of the coal stockpile bench could use <br />a little maintenance soon. There is also some bindweed in the highway ditch and a small patch of bindweed on <br />the coal stockpile bench outslope. <br />The operator continues to work on the wash plant. However, there has been enough work done so that the <br />system could be tested. The final coal waste coming out of the system was fairly dry and does not require much <br />drying for spreading and compacting on the gob pile. <br />The culverts and ditches at the entrance to the mine site were functional. The mine ID sign was up. Surface <br />disturbance markers were up around the mine site. <br />
