III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II-W Mine conducted by Erica Crosby of DMG. Mike <br />Altavilla of Seneca Coal Company was present during the inspection. The Seneca II-W Mine <br />status is active, and mining is currently taking place in the A-Pit. Weather conditions on site <br />were clear and warm. Ground conditions were dry. <br />Roads Roads throughout the mine site are in good repair. Magnesium Chloride was recently <br />sprayed along the tie-across-haul-road. Some of the rock drains along the mine entrance road <br />require maintenance. The G road has recently been graded. Some additional clean up of G road <br />material is necessary. The slide along the mine entrance road has not progressed since the last <br />inspection. Ground conditions are dry, and this slide should be repaired as soon as possible. <br />Hydrologic Balance Ponds 005 and 006 contained water. Pond embankments were well <br />vegetated and stable. The slide at pond 006 has not progressed since the last inspection. A <br />mitigation plan has been submitted under Technical Revision 27, and is currently under review. <br />Stock tank T-24 was dry, T-22 contained water but was not discharging, T-2 was dry and T-3 <br />contained very little water. All stock tank inlets and outlets were in good repair. The ME-5 <br />sump contained sediment, and requires cleaning. <br />Diversion NE-1 was being graded during the end of the inspection to allow positive drainage to <br />flow through the reclaimed B-Pit. NE-3 permanent drainage needs to be reshaped per the <br />designs approved by the Division. Contour furrows need to be properly installed and tied into <br />existing drainages, or removed. <br />Backfilling & Grading The B-Pit NOV area has been regraded to a 3h:1v slope and topsoiled <br />per the specifications in TR-25. The slopes measured at 3h:1 v. The drainage slopes range from <br />10% to 15%. The operator was actively reshaping the drainage NE-1 during the inspection to <br />allow positive drainage. Rip-rap rock may need to be installed in certain portions of the drainage <br />as designed under TR-25. The lower portion of the drainage cannot be constructed due to <br />required backfilling and grading work needed in the B-Pit. Based on this recent work, NOV C-95- <br />023 is being terminated. The slide along the B-Pit highwall has not progressed since the last <br />inspection. The slide is adjacent to the power line access road along the B-Pit highwall. <br />The dragline was working on the upper part of the A-Pit, cutting a new pit to tie into the existing <br />pit. This new pit is along the ridge. Backfilling and grading has occurred in the A-Pit and ties in <br />well with the surrounding reclamation. Some rills and gullies were noted in the 1996 A-Pit <br />reclamation least of neck pit ramp adjacent to topsoil pile GG1. These features need to be <br />repaired, as outlined in the rill and gully plan. <br />No recent backfilling and grading work were noted in the C and D Pits. The C-Pit is scheduled to <br />be reclaimed in 1997 and the D-Pit in 1998. The D-Pit highwall slide has not progressed since <br />the Iasi inspection. <br />
