III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />On June 14 and 15, 1995, a complete inspection was conducted at the New Elk <br />Mine. Conditions were generally clear. The ground was much dryer than the last <br />inspection on June 1, 1995. <br />RDA <br />Portions of upper area diversion were inspected. The next terrace is almost ready <br />to have cover placed on it. The lower slopes were well vegetated except for the <br />benches where vehicles have driven on the vegetation. Recent rains have <br />greened up the vegetation and it was doing well. No wet spots were noted on the <br />pile. Recent flows in the reno mattress have bunched up the river rock even more <br />so than before. Some reconstructed sections have held up well but older <br />sections have not. Some mattresses appeared to have lost some rock. These <br />sections should be repaired as soon as possible. A crossing of wood cribbing <br />had been placed across the drainage to allow maintenance equipment to cross <br />without damaging the channel. This should be removed when not used in order <br />to keep the channel at full capacity. There were several boards that had washed <br />down the channel that should be removed. Maintenance will be required on the <br />access road to the upper RDA area. Recent heavy rains with heavy equipment <br />on the road have pushed some material into the ditch. This should receive <br />routine maintenance as soon as possible. <br />RDA Pond <br />The RDA pond is an MSHA pond with a maximum capacity of 30 acre feet. The <br />pond embankments were well vegetated. There was a sediment delta at the <br />inlet. The pond had been manually dewatered within 48 hours of precipitation <br />events and at the time of the inspection no discharge was occurring. <br />
