III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken dunng the inspection <br />and the facts or evidence supportrng the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology (DMG) The weather on this day was mild and ground conditions <br />were muddy and snow-covered due to recent snowfall. Ron Thompson of Peak Project <br />Management and Bobby Steele of Lorencito Coal Company were present for the inspection. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM) <br />The contact. address. and phone number for PPM is Ron Thompson, Peak Project <br />Management. 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. The liability <br />insurance certificate cancellation clause regwres modification to comply with the Rules. All <br />other records were found in compliance as detailed on page 2a of this report. <br />Roads <br />The Jeff Canyon Haul Road appears to have been bladed recently to improve drainage from <br />melting snow. This road is used by the coal operator to access the disturbed area. It is also <br />used by others to access a number of coal-bed methane wells adjacent to the disturbed <br />area. Culverts along the road were clear and appeared functional <br />Hydrologic Balance <br />Removal of sediment from pond 9 is <br />now complete (see photo on right). <br />Ditches have been restored directing <br />drainage from the sediment storage <br />pad area to the pond via the access <br />road to the pond. The sediment <br />marker remains to be reset in the <br />pond. Ponds 7A and 9A both held <br />water at about 25°/u of capacity. Pond <br />10 at the loadout also held a small <br />amount of water. <br />Pond 8 held a small amount of water ~.:~;` `'~ ~ <br />Pond 5 was about half full of water "'~'~'*" <br />Pond 6A also held water below the ~~i <br />discharge point. All embankments, <br />spillways. and weir boxes appeared in good condition. <br />
