<br />III. COMMENTS -COMPLIANCE <br />.. ..- <br />;;; <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />and sealed in compliance with permit requirements, and the pad <br />sites and associated temporary roads properly graded and seeded. <br />The following exceptions were noted. <br />i. LWi-S has not been sealed. Operator indicated it was left <br />open as a remaining vent hole for the longwall district. <br />2. Many of the holes did not have rock check sediment traps <br />installed within the sediment control berms, as the sites had been <br />reclaimed prior to the incorporation of rock check sediment <br />controls into the permit. However, unless otherwise noted, the <br />combination of revegetation, berms, and contour furrows in place at <br />the reclaimed drill sites appears to be effectively controlling <br />erosion and sedimentation, and further sediment control measures <br />are not warranted. <br />3. None of the sealed wells were marked with the hole I.D. number <br />as indicated on page V-19 of the permit application. The casing <br />caps will need to be properly marked. <br />4. At several well sites, casing extended a foot or more above <br />the ground surface, and needs to be cut off in compliance with <br />permit specifications (LW2-tiB, 4-9, 5-9, and 2-1). Dirt is mounded <br />approximately 4' high around the well casing at LW2-4. The mound <br />should be graded out and the casing cut off, unless appropriate <br />justification is provided. <br />5. Site LW3-5 well was sealed and capped, but the site was <br />apparently not final graded, and if seeding was done it failed. <br />The site, adjacent to Red Wash on the old seismic road is barren, <br />compacted, and rilled, and there is a small soil stockpile <br />remaining. The site should be graded, ripped, soil respread, and <br />seeded. Sediment control including rock checks should be <br />installed. A culvert associated with reclaimed access road between <br />LW3-5 and 3-6 remains in place at a gully crossing. The culvert <br />needs to be pulled, and fill removed from the gully. The upper 150 <br />to 200 yards of the reclaimed access road between the seismic road <br />and LW4-9 is barren and rutted, and should be ripped and seeded. <br />A poorly stabilized road segment between LW3-10 and 3-12 should be <br />similarly treated. <br />6. LW4-17 well has not been sealed, and site reclamation has not <br />been performed. Unless justification for retaining this well is <br />provided, the well should be closed, and the site graded, <br />topsoiled, and seeded. Rock check sediment controls should be <br />installed upon completion of reclamation. <br />
