• (Page 2) • <br />MINE ID t OR PROSPECTING ID /` M-77-205 <br />INSPECTION DATE 04/21/94 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This inspection was conducted by the Division ae part of its ongoing monitoring, to assess <br />the adequacy of the existing bond amount, and because of an internal report of possible non- <br />compliance with the permit. Operator was notified of this inspection and was present after <br />hours at the onsite office for the meeting and inspection. <br />There ie a bit of confusion between the operator and the Division regarding the extent of the <br />permit area. This area was originally permitted by another party ae a limited impact 110 <br />permit. Around 1983 to 1985 the permit was to be converted to a regular 112 permit, but the <br />operator quit the business, and the bank took over permit responsibilities. Maps in the <br />file, submitted by the previous permittee at that time indicate that all areas north of the <br />railroad which bisects this site were to be included, then deleted from the conversion <br />application. In 1989 the current operator took over this permit as a 112 permit, and <br />purchased the entire property also. The property includes extensive areas in the North Fork <br />of the Gunnison River, and the operation mines gravel bars deposited in the river. The <br />operator was under the impression that areas north and south of the railroad were in the <br />permit area, in fact that the permit area consisted of the whole property. The files do not <br />contain any maps that reflect that both the areas are in the permit, but the report from a <br />1992 inspection performed by the Division mention that there was (permitted) mining <br />operations occurring on portions of both areas. <br />There are a variety of activities occurring on this operator's property. Not all of them <br />directly involve mining of the deposit in the permit area. The files need to have an <br />accurate map and better information for the permit area. operator has a recent survey of the <br />property, and was urged to locate and delineate those areas which will comprise the permit <br />area. Such delineation will be on a map to be submitted to the Division, within 60 days. <br />Operator will also delineate permit area by placement of markers on the site, also to be <br />completed and evidence sent to the Division in 60 days. <br />The permit area may be accurately determined as follows: delete all areas not a part of this <br />mining operation, but include all portions which are a part of it, operator must include all <br />lands and facilities used for the extraction, processing, stockpiling, weighing, hauling of <br />the gravel, plus areas used for equipment, topsoil storage, areas planned to be mined in <br />coming years, and diking activities in the river. Once this defined the markers may be <br />installed, the actual extent of the permit acreage may be determined, and a more current bond <br />figure may be calculated.
