J ' (Page 31 • <br />MINE ID # OR PROSPECTING ID # M-79-181 <br />INSPECTION DATE 9/2/99 INSPECTOR'S INITIALS WHE <br />Hydrologic Balance Problem #4, Possible Violation (PV-4) of DMG 7/20/99 inspection report was <br />issued for failure to grade affected areas to control erosion and failure to conduct operations in a <br />manner which minimize disturbances to the hydrologic balance. <br />During this inspection, Mr. Fearn and Mr. Castle clarified that uncontrolled runoff across affected <br />land had resulted from failure of a natural upland drainage channel. Capacity of the natural <br />channel had been exceeded not only due to unusually heavy precipitation throughout August, but <br />also possibly due to runoff being concentrated by an upslope county road. Mr. Fearn indicated <br />that the sediment source for the off-site sediment deposition, identified in DMG 7/20/99 inspection <br />report, was from the eroded natural channel rather than from eroded affected areas. During this <br />inspection, Mr. Castle was utilizing a dozer to re-establish the natural drainage pattern and stabilize <br />affected areas. <br />On 9/7/99, DMG received a book from Mr. Castle titled, Mountain Mysteries. The Ouray Odyssey, <br />by Marvin Gregory and P. David Smith, Wayfinder Press, 1984, which contains a historic photo <br />of the Ruby Trust Mine. The photo indicates that construction of the waste rock mine bench, <br />resulting in constriction and channelization of Snuffels Creek along the permit area, had occurred <br />prior to the permit application. The photo also supports Mr. Castle's statements indicating that <br />Walker Mining and Milling has removed significant quantities of debris from pre-permit mining <br />operations. <br />Plans for consolidation of the pyritic ore materials into one stockpile and providing drainage control <br />for the potentially acid forming materials were discussed. The operator's agent has agreed to <br />provide plans for the ore stockpile area, with descriptions of the proposed hydrologic controls, <br />through the Technical Revision process. DMG also requests that the operator submit the lab <br />analysis reports from the water monitoring conducted in accordance with the CDPS permit CO- <br />0037206. <br />Therefore, DMG has withdrawn the possible violation for failure to control erosion and minimize <br />hydrologic impacts. DMG has withdrawn the issue from the Board's October 20-21, 1999 agenda. <br />Unpermitted Facilities Problem #5 IPB-5) of DMG 7/20/99 inspection report, was issued for <br />unpermitted facilities.
