III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the (acts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. Bill Bear represented the operator during the records check. No one represented the operator <br />during the field inspection. During the•last part of the inspection, it was snowing at the higher <br />elevations of the mine site. <br />Roads <br />All of the roads were dry and in good condition. Road ditches and culverts were functional. <br />Siens and Mazkers <br />Mine ID signs were present at the required locations. Surface disturbance mazkers were up azound the <br />mine site. <br />•8 <br />Hvdrologv <br />The train loadout pond, the ROM stockpile pond, the west ridge waste pile pond, ponds 1, 2, 3 and 4 <br />were dry. The west mine pond and the highway coal stockpile pond had water to within 3 to 4 feet of <br />dischazge. All of the pond embankments and bin walls were stable. All spillways were functional. <br />Culverts and ditches around the mine site were functional. At the east mine, rocks have fallen into the <br />ditch at the temporary coal stockpile azea. The rocks should be removed before sediment builds up <br />behind the rocks and blocks the ditch. At the west mine, the straw bales behind the main topsoil <br />stockpile need replacing. Also, the silt fence on the south facing slope of the west mine bench needs <br />small repairs. <br />Gob Piles <br />There have been no new additions to the west ridge waste pile. The straw bale in the berm notch needs <br />repair. The reclaimed slopes aue well vegetated and appeaz to be stable. The collection and diversion <br />ditches and culverts were functional. <br />The reclaimed old waste pile was well vegetated. No signs of geotechnical instability were observed. <br />
