III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Marr Strip Mine and Walden loadout facility conducted on <br />June 24, 2005 by Mike Boulay of the DMG. There was no representative from Ken Coal <br />Company present during the inspection. Weather conditions were sunny and warm. Ground <br />conditions at the site were mostly dry. <br />Availability of Records <br />Records were reviewed at NWCC's office in Steamboat Springs on the afternoon of June 22, <br />2005. Please see the attached Availability of Records checklist. The files have not been updated <br />with the second, third, and fourth quarter 2004 quarterly pond inspections, and the annual <br />certification for impoundments for 2004. The current Certificate of Liability Insurance was also <br />not located in the records file. Please locate these items and update the records file accordingly, <br />and continue to maintain and update all records on a regular basis. <br />Roads <br />The permanent light use road was accessible and dry. As noted in the prior inspection, <br />significant erosion is occurring on the road. At approximately .2 miles inside the access gate rill <br />formation and erosion is occurring on the west side of the road due to spring runoff and <br />snowmelt. At approximately .9 miles inside the gate the road becomes rutted. The road ditch <br />along the west side of the permanent light use road is down cutting in some isolated areas. The <br />permanent road and ditch will require maintenance. Please maintain the permanent road and <br />ditch by grading particularly in azeas where erosion is occurring. <br />Hydrologic Balance <br />Sedimentation Ponds A, B, C, D, E, F, and G were inspected, and all of the ponds were retaining <br />water. The water appeazed to be murky in all of the ponds. All of the ponds were retaining <br />significant amounts of water, but none of the ponds were dischazging. Cattle were drinking from <br />Pond G and grazing in the vicinity of Pond G, but no other cattle were noted elsewhere on the <br />mine site during the inspection. Pond inlets and embankments are stable and no problems were <br />noted at any of the sediment pond locations. <br />Site ditches PD1 through PD4 were inspected. PDland PD2 aze vegetated and appeaz stable with <br />no significant erosion problems noted. A couple of small rills have formed on the hillside <br />between PD 1 and PD2. Some water had ponded at the base of the hill between PD 1 and PD2. <br />
