III. COMMENTS -COMPLIANCE <br />Below are comments on the Inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />East Mine <br />The gate at the entrance was locked. The mine id sign was up at the gate. The paved, graveled and ' <br />dirt roads were in very good condition. Surface disturbance markers were up, along the <br />disturbance boundary. <br />There have not been any recent work done on any remaining facilities stmctures at the East Mine, <br />except that the 10,000 gallon waste tank was emptied out. <br />Ditches were in very good condition. There had been recent maintenance done on the ditches. <br />Culverts had sufficient capacity. The straw bales surrounding the drop inlet on the <br />crusher/screener bench will need maintenance soon. <br />Ponds 1, 2 and 4 were dry. Pond 3 was wet but had no standing water. Spillways were functional <br />and the bin walls appeared to be stable. <br />There have not been any recent additions to the West Ridge waste pile. The vegetative cover was <br />very good. There were no signs of slope instability or erosional gullying. Collection ditches and <br />the diversion ditch all had sufficient capacity. The outlet of the culvert at the bottom of the hill of <br />the West Ridge waste pile haul road could use a little maintenance soon although it still had <br />enough capacity. The sediment pond was dry. Spillway tubes were clear. The emergency spillway <br />was functional. There were no signs of slope instability or erosional problems at the reclaimed old <br />waste pile. The vegetative cover was very good there as well. <br />Train Loadout <br />The three entrance gates were open but there were no coal haul trucks on site during the <br />inspection. There was no unit train at the site either. The sediment pond was dry. Collection and <br />diversion ditches, and the associated culverts were functional. Benns were also intact. There were <br />no leaks at the fuel facility. There were no signs of gullying at the topsoil stockpile. <br />Hi¢hwav Coal Stockpile <br />No erosional gullying was observed at the temporarily reclaimed site. There was a little water in <br />the sediment pond. The straw bales were up along the outside slope of the rail line and around the <br />inlet of the western culvert. There was a moderate stand of vegetative cover. The mine id sign <br />was up. <br />Records Checklist <br />The records were in compliance.
