III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Basil Bear <br />represented the operator during the records check. No one represented the operator during the <br />field inspection. There was no activity at any of the mine site locales. The weather was dry and <br />cool. <br />West Mine <br />The road leading from the Stevens Gulch Road to the West Mine was dry and in good condition <br />Road culverts had sufficient capacity. The mine id signs were up at two locations. Surface <br />disturbance markers were present around the disturbed area. <br />A concrete cap with a vent pipe was constructed over the backfilled fan shaft. The operator <br />supplied the DMG with appropriate pictures documenting the work. The cap was, then, covered <br />with dirt. The vent pipe stands about 6 feet out of the ground. Bowie has requested that the vent <br />pipe be removed since it acts as a lightening rod. The DMG is reviewing the issue. The silt fence <br />at the fan site was functional. The topsoil stockpile was well vegetated and a topsoil sign was <br />present. <br />There was a fair vegetative cover at the backfilled and graded portal bench site. A little Tilling <br />was observed in the lower central area of the site. Some thistle has come up in an azea just <br />northwest of the upper pond. This thistle needs to be removed very soon. Vegetation was growing <br />on the livestock trail. The upper pond was dry while the lower pond had a little water in it. The <br />primary discharge tube gate on the upper pond was open while that on the lower pond was closed, <br />as designed. Pond embanlanents appeazed to be stable although the vegetative cover was spazse. <br />Riprap in the embankment downdrains was intact. <br />Well Field <br />The mine id sign was up. The topsoil sign was up and the topsoil stockpile was moderately to <br />well vegetated. There were a few cows on site but no damage was observed. <br />Run-of--Mine Coal Stockpile <br />The haul road was well graveled and in excellent condition. The mine id sign was up at the <br />entrance and surface disturbance markers were present. The topsoil stockpile was off of its post <br />and should be put back up. There were no signs of gullying at the topsoil stockpile. Culverts and <br />ditches were functional. The collection ditch that leads into the south end of the sediment pond <br />was well grassed. There was only a little water in the sediment pond. The gated primary was <br />closed. <br />
