M1 • (Page 2) • <br />MINE ID # OR PROSPECTING ID # K-90-098 <br />INSPECTION DATE 2 2 96 INSPECTOR'S INITIALS CLK <br />OBSERVATIONS <br />The following observations were made during a routine inspection of the site, which ie <br />currently active. <br />1. Signs and markers are in place and visible. <br />2. Approximately 20 acres ha~..been disturbed thus far. Some areas of the permit will never <br />be mined, since they have become entangled in legal wetlands issues. It is recommended that <br />Asphalt Paving ask for release of these areas, since they have never been disturbed and never <br />will be. <br />3. Mining has occurred within 5 feet of the southern boundary (the setback is 25 feet). <br />Asphalt Paving is currently in violation of their permit because of this disturbance near the <br />southern boundary. The pit has not been mined at 3:1 as required by the mining plan, and <br />repairing the southern boundary will be extremely difficult without the setback above the <br />pit, since it is too narrow to be used ae a ledge from which to backfill the pond. <br />4. The main pit ie approximately 25 feet deep and full of water at this time. Headcutting <br />along the southern and eastern boundaries is going to be backfilled, according to Mr. <br />Sampson. While this is an acceptable method of repairing the slopes, these extra tasks exceed <br />the amount of financial warranty posted. <br />5. Pictures were taken during the inspection; copies of these pictures were requested by the <br />operator. DMG will send copies of these photos after the operator pays for them to be made. <br />6. Topsoil stockpiles must be seeded with Western wheatgraes. Currently they are covered with <br />cheatgrase. <br />7. There ie a strong possibility that the financial warranty ie inadequate for the level of <br />disturbance at the site.
