Eagle No. 5 & 9 Mine: pC. 2 <br />We spent the remainder of December IS making general field observations of conditions at the <br />mine. As mentioned above, snow cover limited some observations. We inspected all disturbed <br />areas of the mine and walked through the reclaimed Williams Fork surface mining area. The <br />reclaimed area seemed well vegetated and stable. Mule deer were noted throughout the reclaimed <br />azea. The permtttee is encouraged to pursue bond release for this area to the extent possible. We <br />made stops and/or observations of the following: Eagle No. 5 Mine reclaimed portals adjacent to <br />the main facilities area; coal stockpile/rotary breaker and overland conveyor to portal SA; sewage <br />lagoon and water treatment ponds; unit train loadout azea; major facility azea sediment pond; <br />sediment ponds la and lb along the haulroad corridor; Williams Fork reclaimed surface mining <br />area; portal SA area including the sediment pond SA1; rock storage area; old facilities area which <br />includes the old shop building and two sediment ponds; mine dewatering at the 7 North Angle <br />site which discharges through pond 9p2 and 9p3, discharge was clear (NPDES outfall); and we <br />concluded at the former No. 9 mine area which includes two ponds (including potential mine <br />dewatering pond) and waste rock storage azeas. This concluded our field inspection. Surface <br />facilities appear well maintained and clear of excess debris/equipment. No off-site impacts were <br />noted during the field inspection. <br />On December 16 Mr. Walker conducted a very thorough review of required permitting and <br />environmental monitoring documents. The review included: December 4, 1995, Cyprus Empire <br />temporary cessation notification to DMG; current liability insurance; current NPDES/DMR's and <br />current surface and ground water sampling data; December 10, 1998, letter from Cyprus Empire <br />to DMG documenting removal of the former training center and administrative buildings and Mr. <br />Mills indicated the engineering and maintenance buildings will also be removed. The bond is <br />held by Aetna Casualty and Surety Co., No. 64S 100238520BCA, in the amount of <br />$3,351,497.00. These and other records reviewed were in order. Water monitoring reviewed did <br />not indicate any off-site impacts, nor were other off-site impacts noted.
