December 21. 1998 <br />Cyprus Empire Corporation <br />P.O. Box 68 <br />Craig, CO 81625 <br />Eagle 5 & 9 Mines <br />Complete oversight inspection <br />December 15 & 16, 1998 <br />Participants: <br />Rick Mills, Cyprus Empire Corp. <br />Byron Walker, Colorado Division of Minerals and Geology (DMG) <br />Henry Austin, Office of Surface Mining (OSM) <br />I participated in a complete oversight inspection of the above operation. Weather conditions were <br />cold and sunny and 4 to 5 inches of snow covered the ground making some observations <br />difficult. The primary focus of the inspection was to evaluate off-site impacts and reclamation <br />success. This site was selected for evaluation by the Colorado/OSM Oversight Team as it <br />represents a site which is in temporary cessation. In addition, we reviewed two permitting actions <br />which are required to be filed for public review at the Miffed County Courthouse. Public <br />availability of records is being evaluated by the Colorado/OSM Oversight Team during <br />Evaluation Year 1999 as part of the Team's Annual Performance Agreement. <br />Prior to the inspection I reviewed permitting and inspection /enforcement records at OSM's <br />Denver office including the following: March 10, 1998, DMG letter to OSM determining <br />completeness for Permit Revision No.3; March 19, 1997, DMG decision for TR No. 29 Midterm <br />Permit Response; September 30, 1997, DMG decision for TR No. 30 Subsidence Monitoring <br />Suspension and Elimination; BLM lease C-0126480 readjustment effective January 1996; BLM <br />environmental assessment dated July, 1995; July 11, 1994, DMG decision for TR No. 23 <br />Hydrologic Monitoring Modification; and the DMG February 28, 1994, Permit Renewal No. 2 <br />for the Eagle Mines. I also reviewed the PHC determination in the permit renewal. <br />We began the inspection by reviewing the public records at the Miffed County Courthouse. Mr. <br />Walker determined prior to the inspection that Permit Renewal No. 3 for the Eagle Mines and <br />Technical Revision No. 4l for [he Colowyo Mine should be available for public review. We were <br />able to locate both records. The County Clerk's office had a well organized tracking system for <br />documenting coal mine permitting actions on file. We were able to use this system to locate both <br />records. Mr. Mills indicated he has experienced very little public contact or input based on public <br />review of information available at the County Courthouse throughout his 20 years working in this <br />area. <br />
