The inspection was <br />from the afternoon of 10/20, through the morning of 10/23. The three SMC <br />representatives were not present together for the entire inspection, but a <br />representative was present at all times. <br />ENFORCEMENTACTIONS <br />MLRD has not issued NOV's as of this date (10/27/92) that resulted from the <br />inspection, but has stated that two NOV's will be issued. The NOV's are for: failure <br />to pass all surface runoff through a siltation structure, regulation 4.05.2 (1), and <br />failure to store non-coal waste in a designated portion of the permit area, regulation <br />4.11.4 (1) & (2). The part of the site that did not pass through a pond was the coal <br />stockpile and shop areas. SMC is currently changing their surace drainage plan <br />to utilize two new ponds that would replace the thirteen existing ponds. In <br />constructing one of the new ponds, excavated material was placed in one of the <br />old pond locations which eliminated the structure and resulted in this failure to <br />pass. SMC should have stored the excavated material in another location. The <br />non-coal waste violation applies to two areas; the waste stored in the east storage <br />yard and the waste/material stored in the explosives area near Elk Creek. SMC <br />must revise their permit to address temporary and/or permanent non-coal waste <br />storage. The permit currently ignores this subject. The waste stored in the east <br />storage yard may have to be moved because the diversion for the gob pile routes <br />runoff to this location. <br />
