III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a complete inspection of the McClane Canyon Mine, conducted by Dan Mathews of the DMG Grand <br />Junction Field Office. Mine Manager Walter Whitledge was contacted at the beginning and the conclusion of the <br />inspection, but he did not accompany during the field inspection. Weather was clear and very warm. Ground <br />conditions were dry. Coal was being conveyed out of the mine and loaded onto trucks during the inspection. <br />Availability of Records <br />Required records were on file and up to date through the 1~~ quarter, 2006. <br />Signs and Markers <br />Permit I.D. sign needs to be replaced or modified to reflect the recent permittee name change, from <br />Central Appalachia Mining, LLC to CAM Mining LLC. Marcia Whitledge at the mine office indicated that the <br />signs had been ordered and would be installed shortly. <br />Roads <br />Haul Road surface, ditches, and culvert inlet sumps had recently been maintained and were in good condition. <br />Grading had been conducted with atrack-hoe along the haul road fill slope near the Culvert "H" inlet, to pull <br />excavated sediment away from the creek channel in April. The graded slope needs to be seeded and <br />mulched; mulch will need to be anchored by tackifier or netting. Seeding should be completed during <br />the approved summer seeding period (midJuly through August). <br />Hvdrolooic Balance <br />There was modest, cloudy flow in East Salt Creek, but not in McClane Creek, at the time of the inspection. <br />The sediment pond contained water a few inches below the elevation of the gated spillway inlet. The <br />embankment appeared stable, with no evident settling or seepage. <br />SAE silt fences were properly maintained and functional. <br />Wood pallets at the Culvert "A" inlet need to be removed. <br />Further modification of the Diversion Culvert "D" riser structure (large fan area diversion culvert) is <br />warranted. Specifically, the riser should be reduced in height by approximately 2 feet or more, to <br />provide for substantial freeboard between the top of riser and the lip of the incised sump. The <br />remaining riser structure should be liberally pertorated to ensure rapid dewatering of sump inflow. The <br />metal grate needs to be secured to the top of the riser. <br />The old broken up shotcrete lining of the steep segment of shop area collection ditch has been properly replaced <br />by a concrete set metal half-culvert. A water wagon currently stored in the ditch at the corner of the shop <br />will need to be removed. <br />The dried material from in the sediment drying area adjacent to the sediment pond had been hauled to the coal <br />waste disposal site in the Munger Canyon permit area during April. A small quantity of mud and coal fines from <br />ditch cleanout has been placed in the drying area since that time. <br />3 <br />
