Lrv+p <br />Drvie~on Ortrcnn <br />RE: Status of Problems (PB) 1 & 2, Identified in DMG 1 /24/96 Inspection Report, <br />Bartley Gravel Pit, Permit No. M-84-155. <br />Dear Mr. Huskey: <br />Thank you for your prompt response to PB 1 & 2 of DMG 1 /24/96 inspection report. <br />DMG received your letter, dated 2/13/96, on 2/16/96. The purpose of this letter is to <br />record the status of PB 1 & 2 and to provide clarification as to how PB 1 & 2 can be <br />satisfied. <br />PB 1 -Issued for mining activities approaching closer than 50' ,from the utility pole <br />located at the east side of the permit area and for lack of information required by Rule <br />6.4.19 for the utility poles and buried gas pipeline within the permit area. <br />Operators response, contained in 2/13/96 letter, states that the island of material <br />remaining around the utility pole located at the east side of the permit area, will <br />be backfilled to provide 3H:1 V slopes and revegetated as weather conditions <br />allow. Upon completion of backfill and re-seeding for the utility pole, please <br />inform DMG so that Corrective Action for this portion of PB 1 can be documented <br />as having been completed. <br />The second portion of PB 1 requested the information required by Rule 6.4.19~or <br />significant, valuable or permanent man-made structures located within 200' of <br />affected land. Operators response, contained in 2/13/96 letter, stated that future <br />mining activities would not encounter additional utility poles. Operator also <br />stated that the original permit conditions required only 50' setback distance from <br />the buried gas pipeline and that mining activities have already bypassed the <br />location of the pipeline. DMG 9/26/94 adequacy letter, for the conversion <br />application of the Bartley Pit, stated, "...for any mining that is planned to occur <br />within 200' of any structure" (powerpoles and buried pipelines, "please include <br />statements from the owners of the various structures either waiving liability for <br />damages or setting out an agreement for potential damages."
