(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1977-378 <br />INSPECTION DATE 10/2/06 <br />INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This inspection occurred to verify completion of final reclamation for the Power Plant Tailings Project area and to <br />verify reclamation progress at the American Tunnel area. The Sunnyside Mine permit includes lands at the <br />American Tunnel facility, Mayflower Tailings Pond 4 area, Power Plant area, Terry Tunnel area, and Lake Emma <br />area, totaling 159.49 acres. The Operator pursues final reclamation at all permit areas. DMG holds $146,151 <br />financial warranty. Affected lands will be reclaimed to support a combination of wildlife habitat and rangeland post- <br />mining land use. This inspection was limited to the American Tunnel facility and lands at the Power Plant area. <br />Eleven photos and a reclamation cost estimation totaling $60,534 accompany this inspection report. <br />On November 7, 2006, the Operator submitted a release request (AR-04) for the 10.56 acres area known as the <br />Power Plant Tailings Project area. As noted in the release request, the Operator had previously completed <br />reclamation atthe Power PlantTailings area but had not requested release forthe completed reclamation. During <br />2003, the site was re-disturbed as part of a Consent Decree project. Under the Consent Decree project, the <br />Operator relocated pre-law tailings from near bank regions of the Animas River to Mayflower Tailings Pond 4. <br />DRMS reviewed and approved the work plans through TR-26. As shown in the enclosed photos, pre-law tailings <br />had been relocated and affected lands reclaimed in accordance with the plans approved through TR-26. Backfilled <br />and graded areas appeared stable, no evidence of settling, slumping or excessive erosion were observed. <br />Transplanted willow clumps appeared to be thriving and are expected to continue to spread across the flat, low- <br />lyingareas. VegetativecoverfortheAnimasRiverembankmentappearednotnecessaryforerosioncontroldueto <br />the large rock and cobbles composing the embankment. However, the Operator succeeded in establishing <br />vegetative cover for the embankment at least equal in extent of cover to surrounding similar areas. Observations <br />made during the inspection and recorded in this report indicate that the Operator has completed reclamation in <br />accordance with permit conditions and the Act and Rules forthe 10.56 acres area addressed underAR-04. DRMS <br />recommends approval of AR-04. With the approval of AR-04, the permit area will reduce from 159.49 acres to <br />148.93 acres. <br />Reclamation activities at the American Tunnel facility were active during the inspection. All mine related buildings <br />and structures had been removed with the exception of the Quonset Hut, Reagent Addition WaterTreatmentPlant <br />building and the Change/Dry Room building. The three remaining buildings will remain as permanentstructures as <br />requested by the landowner and approved through previous revisions. The portal for the American Tunnel had <br />been backflled. Portal drainage is conveyed through the backfill material in a 24 inch diameterABS culvert. After <br />the culvert, portal drainage is conveyed to Cement Creek by an open channel ditch. Slopes had been reduced by <br />a combination of balanced cut and fill and/or backfill to stable configurations which blended with the surrounding <br />native topography. No Backfilled slopes appeared steeper than 2H:1V. Reclamation seed mix and mulch were <br />being applied as soon as final grading was completed. <br />Pursuant to Rule 4.2.1(4), DRMS has reviewed the current cost of reclamation totaling $60,534.
