III. GOMMENiS-COMPLIANCE <br />Below are comments on tha inspection. The comments include discussion of observations made during the inspection. Comments <br />also describe any enforcement actions taken during the inspection and the facts of evidence supporting the enforcement action. <br />Coal was being taken from the West Pit by drill and blast, front-end loader, and truck <br />haul. A picture was taken of operations in the X-Seam pt the southwest corner of the <br />West PIT and a picture was taken of the extent of mining to the west at the <br />northwest corner of West Pit. Coal was being taken by highwall mining in the East Pit, <br />front-end loader, and truck haul. This coal was being hauled to the primary crusher <br />(or the primary crusher coal stock pile) and then to the Gossard Rail Loadout. There <br />was no activity in the Section 16 Pit. <br />FISH & WILDLIFE: Only one deer was seen, and it was in the area to be stripped in <br />advance of the West Pit. Ducks were seen in a wet depression on the East Pit <br />reclaimed area. The new power line constructed on the eastern edge, south end, of <br />East Pit reclamation is of such a design that raptor guards are not required. <br />REVEGETATION: The CSU test plots were inspected along with Ed Redente and Mark <br />Paschke of Colorado State University (on an inspection trip of their own). The test <br />plots looked good. In general shrubs and diversity was higher in areas of no topsoil <br />(few grasses) and productivity was higher in areas of 18 inches of topsoil (more <br />grasses). The area of 6-inches of topsoil fell between the other two. Pictures were <br />taken. Spraying of weed is scheduled for next week by contract. <br />EXCESS SPOIL & DEVELOPMENT WASTE: No work had been accomplished on the West <br />Pit Excess Spoi{ Fill. <br />SPECIAL CATEGORIES OF MINING: As noted above, highwall mining is underway in <br />the East Pit. <br />OTHER: The operator indicated a possibility of an application to upgrade the light duty <br />road up Taylor Creek to a haul road, and perhaps an application to contour and <br />highwall mine the ridge between East Taylor Creek and Wilson Creek. A reconnaissance <br />was made up both drainages as a general orientation of these areas for this potential <br />work. <br />C-81-019. Page ~l of ~Paaes.
