Section 34-32.5-12312) of the Act, states that <br />an operator who mines substantial acreage beyond the approved permit boundary may be found <br />to be operation without a permit. DMG area estimates are based upon vehicle odometer readings <br />and therefore contain the inaccuracies inherent in utilizing vehicle odometer to measure short <br />distances. <br />CORRECTIVE ACTION: Conduct survey of the permit area and all areas affected by the mining <br />operation: Submit updated map(s) of all areas affected, prepared and signed by a registered land <br />surveyor, professional engineer, or other qualified person, and which satisfy all applicable <br />requirements of Rules 6.3.5 and 6.2.1. Confusion exists in the permit records regarding permitted acreage and configuration of permit <br />boundary. DMG records do not indicate that the operator has submitted application for <br />modification of the permit area from the 8.0 acres originally approved. Annual report, submitted <br />by the operator, for 1996 states permit acreage as 10 acres. <br />CORRECTIVE ACTION: Submit corrected annual report for 1996, showing 8.0 acres affected <br />area, as the approved permit acreage. <br />4/7/97 <br />PB or PV PB <br />TOPICIS) AR <br />3. Mine identification sign was posted east of the entrance to the permit area, displayed an <br />incorrect permit number and lacked the statement that a reclamation permit for the operation had <br />been issued by the CMLRB, Rule 3.1.1211) requires the operator to post identification sign at <br />the mine entrance which displays the name of the operator, permit number and a statement that <br />a reclamation permit has been issued by the Colorado Mined Land Reclamation Board. Affected <br />area perimeter markers, required by Rule 3.1.12(21, were not observed. <br />
