~ ~ IPage 31 • <br />MINE ID # OR PROSPECTING ID # M$3-759 <br />INSPECTION DATE 2/27/97 INSPECTOR'S INITIALS WHE <br />TOPSOIL -Topsoil stockpile, identified in Mine Plan Maps and annual report maps, was located in <br />the SW corner of the permit area. Topsoil had also been recently stockpiled along the north end <br />of the pit expansion. Protective vegetative cover for the stockpiled topsoil was sparse or absent. <br />Rule 3.1.911) requires the operator to establish protective vegetative cover for topsoil stockpiles <br />which will remain stockpiled for periods of time exceeding 1 year. <br />HYDROLOGIC BALANCE -Elevated fuel tank, several 55-gallon drums and pallet of bagged fertilizer <br />were located within the pit. All fuels, lubricants and chemicals need to be stored in a controlled <br />manner, at a designated location, with adequate spill prevention and spill containment controls. <br />Spill containment controls typically include measures such as construction of a containment berm <br />surrounding each fluid storage area. Berm surrounding each fuel tank should enclose sufficient area <br />to ensure containment of volume equivalent to enclosed tank capacities. Containment areas should <br />be lined with an impermeable liner to ensure spilt fuel or fluids not escape and degrade quality of <br />ground and surface waters (Rules 3.1.6 and 3.1.71. <br />FINANCIAL WARRANTY -Changes to the Mined Land Reclamation Act, due to the passage of <br />Senate Bill 91-177 in 1991, included the removal of the 55000.00 bond cap for 110(2) type <br />permits. All mine sites in Colorado are now required to be bonded for the actual cost of reclamation <br />if, in the case of permit revocation and bond forfeiture, the state were to put the reclamation work <br />out for competitive bid. Review and recalculation of the required bond for reclamation of this <br />operation will take place over t-le next few months. A detailed estimate of the recalculated cost, <br />based on the approved mining and reclamation plans and conditions observed during the inspection, <br />will be forthcoming. <br />Numerous vehicles, mobile homes and equipment, in various stages of dismantlement, have been <br />discarded along the north, west and east sides of the pit area. Vehicle batteries, discarded oil filter <br />and 55-gallon drums, contents unknown, were observed among the debris. DMG review of the <br />financial warranty will include disposal cost for all debris located within permit area. <br />MINE PLAN COMPLIANCE -Operation is approved to affect 8.0 acres. Approved activities includes <br />material excavation, crushing, sorting and stockpiling. Pit highwall was visually estimated at 20' <br />height and appeared stable. Pit is progressing north, topsoil had been stripped from the expansion <br />area and stockpiled along the north side of the disturbance. Pit daylights to natural slope along <br />south side. Tandem axil end durnp truck, two loaders, excavator, portable crusher with conveyors <br />and generator were located within the pit. Large metal tank was also located within the pit area. <br />Operator stated that large tank was utilized in concrete production and had been purchased by <br />another party but had not been removed from site. <br />Mine Plan Map and maps submitted with annual reports, depict a square permit area, 600' x 600'. <br />Observation made during this inspection, estimate a rectangular affected area of 0.1 mile x 0.25 <br />mile. DMG inspector utilized vehicle odometer to measure extent of affected area. If DMG field <br />estimates are correct, the operator may have affected approximately 16 acres. Please submit <br />professional quality, scaled map(s-, showing all areas affected by the mining operation. Submitted <br />map(s) must be prepared and signed by a registered land surveyor, professional engineer, or other <br />qualified person, and satisfy all applicable requirements of Rules 6.3.5 and 6.2.1 . <br />
