T ~ (Page 21 <br />MINE ID # OR PROSPECTING ID # <br />INSPECTION DATE 2/21/97 <br />M-83-159 <br />INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This complete inspection was ~:onducted by Wally Erickson from the DMG Durango office, 484 <br />Turner Drive, Building F, Suite 101, Durango, CO 81301, phone (970) 247-5193. Tom Farmer was <br />present during the inspection. The Gleason Pit permit was originally issued on 1 /30/84 to Montrose <br />County, for 8.0 acres affected area. On 114/94, DMG approved transfer of permit and succession <br />of operator ISO-011, for Tom and Regina Farmer, dba Farmer's Construction Company, Inc., as <br />successor operator. DMG records do not indicate additional modifications, other than SO-01, being <br />approved for permit no. M-83-159. Gleason Pit is located approximately 2 miles SE of Redvale, in <br />portions of the SE 1 /4 of the NE 1 /4 of Section 15, T45N, R14W, NMPM, Montrose County. DMG <br />holds financial warranty in the amount of 512,000. Intermittent snow cover, approximately 2" <br />depth, was present, soil conditions were muddy. No activity was observed at the pit, operation <br />appeared dormant. <br />All Rules referenced within this inspection report are taken from the Construction Materials Rules <br />and Regulations of the Colorado Mined Land Reclamation Board, effective 1 /96. Sections of the <br />Act referenced within this inspection report are taken from the Colorado Land Reclamation Act for <br />the Extraction of Construction Materials, 34-32.5-101 ET SEO, C.R.S., 1995, as amended. If the <br />operator does not possess a current copy of the Act and Rules, one may be requested for 58.00. <br />RECORDS - Confusion exists in the records concerning permitted acreage and configuration of <br />permit boundary. Original permit was approved for 8.0 acres affected area. Hand drawn map <br />submitted with the original application, depict a square permit area of 600' x 600', suggesting <br />permit acreage of 8.26 acres. Annual report, submitted by the operator, for 1992 contained the <br />600' x 600' map, indicating permit area of 8.26 acres. Annual report for 1993 stated 8 acres <br />affected area. Annual report for 1994 stated 9 acres. Annual report for 1996 stated 10 acres. <br />DMG records do not indicate that operator has submitted request to modify or enlarge the permit <br />area, therefore the permit area remains at 8.0 acres as originally approved. Please clarify. <br />Should the operator desire to rnodify the configuration of the permit boundary or increase the <br />permitted acreage, such requests are appropriately submitted through the Technical Revision, <br />Amendment, or Conversion processes described in Rules 1.116), 1.1(49), 1.9, 1.10 and 1.1 1. <br />SIGNS & MARKERS -Mine identification sign was posted east of the permit area and displayed the <br />name of the operator and permit no. M-33-159. Rule 3.1.1211) requires that the operator post mine <br />identification sign at the entrance to the mine site which displays the name of the operator, the <br />permit number, and a statement that a reclamation permit has been issued by the Colorado Mined <br />Land Reclamation Board. Pursuant to Rule 3.1.12111, please correct the permit number, include the <br />statement regarding permit issuance, and relocate the sign to the mine entrance. Current location <br />of sign suggests that portions of the access road and area of stockpiled construction equipment, <br />located west of the sign but east of the actual permit boundary, are included within permit area. <br />Affected area perimeter markers, required by Rule 3.1.1212), were not observed. Permit boundary <br />markers are essential to ensure that mining activities remain within approved areas and to enable <br />DMG to verify compliance with permit conditions. <br />
