III. COMMENTS -COMPLIANCE 1~n `d~~ ~~tt lG ~`t ~`~~~ <br />P~%Y ?T~ ~~ ~~ <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Sanborn Creek Mine conducted by Jim Stark <br />of CDMG. Jim Kiger of OMLLC accompanied me on parts of the inspection. A bond <br />compliance inspection was also performed at the site. The mine was actively mining <br />coal and shipping it via train. The weather was warm and sunny and the ground was <br />dry. <br />Availability of Records: All of the necessary records were available in the mine office. <br />See the records check list at the end of this report for more detailed information. <br />Signs and Markers: All of the necessary signs (including the mine ID signs, permit <br />boundary markers and topsoil stockpile signs) were in place as required. <br />Roads: -The main mine entrance road and the roads in the Sanborn Creek facilities <br />area were well maintained and in good condition. <br />-The West Valley and Elk Creek Haul Roads (the roads to the Elk Creek facilities area) <br />were well maintained and in good condition. <br />-The Sanborn Creek Mine road and the East Yard Haul Road were well maintained <br />and in good condition. <br />-The light use road to Pond D was well maintained and in good condition. <br />Hydrologic Balance: - Pond A is a sump below the loadout and coal silo. The pond <br />contained a small amount of water but was not discharging at the time of the <br />inspection. The pond embankment was well vegetated and stable and there were <br />no signs of erosional problems on the embankment. The principle spillway is a CMP. <br />The emergency spillway is the top of the pond/road. The emergency spillway is not <br />very well defined. <br />- Pond B contained water but was not discharging at the time of the inspection. The <br />pond embankment was well vegetated and stable and there were no signs of <br />erosional problems on the embankment. The primary spillway is a gated valve. The <br />emergency spillway is an open channel that appeared to be constructed and <br />maintained as required. <br />- Pond D contained water about two feet below the discharge pipe and was not <br />discharging at the time of the inspection. The pond embankment was well <br />vegetated and stable and there were no signs of erosional problems on the <br />embankment. The emergency spillway is CMP. <br />-The East Yard Pond was muddy/soupy at the bottom. The pond was not <br />discharging at the time of the inspection. The pond embankment was well <br />vegetated and stable and there were no signs of erosional problems on the <br />embankment. <br />- The mine water sump contained a small amount of water. The sump was stable <br />and in good condition <br />
