111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Janet Binns, of Colorado Division of Minerals and <br />Geology. Mr. Forrest Luke and Mr. Frank Self accompanied the inspection. The weather was warm <br />and cloudy with thunderstonns moving in. The mine is an active surface mine. <br />Records: Blasting 2004 public notice was published in the Craig Daily Press on <br />February 20, 2004. The operator provided a copy of the newspaper public notice. <br />Roads: Haul roads throughout the mine were in good condition. Access roads were in good condition. <br />Hydrologic Balance: The snowpack has already melted off, except for small patches at the higher <br />wooded elevations. Many of the ponds were holding water but not discharging. Ponds that were <br />discharging included No Nome #5 and Johnson l OR.. Discharge from these two ponds was clear. No <br />Name #5 was discharging 0.26 on staff gauge. Johnson l0R was discharging 0.16 on the staff gauge. <br />No problems were noted with pond inlets. <br />Drainages throughout the reclaimed areas had held up during runoff season with no check dam <br />damage or excessive sedimentation. Repairs to East Pyeatt drainage had performed well this runoff <br />season. No maintenance concerns were identified in any of the major drainages. <br />Regraded west buzzard ponds and collection ditches in the Buzzard drainage had performed well over <br />the winter and runoff. Minor rilling had occurred in these 2003 reclaimed areas. Rills were shallow <br />and of limited duration. No repair of these rills is necessary at this time. <br />Reinforcement on the East Pyeatt #l pond embankment has held up well. Vegetation on this <br />embankment should come in this spring. <br />Backfill & Grading: G-test pit has begun to be filled with spoil material from the pre-strip in advance <br />of Z Pit. Z-pit continues to advance to the south. Dragline pad has been constructed in the bottom of <br />Z Pit on the spoil side. The boxcut spoil pile does not appear to have additional materials added to it. <br />F Pit continues to progress to the east. Highwalls appear stable and no problems were noted with Pit <br />F. <br />G-strike pit has progresses to the second cut (GS). Spoil material has been used to construct the <br />dragline pad. The length of G-strike pit has not extended to the East but the floor of the pit is <br />widening. Boxcut spoil pile continues to enlarge. Pit progress appears to be in accordance with the <br />approved mine plan. <br />Explosives: Old explosives area has been partially regraded area. The pole barn and fencing remain at <br />the west side of the storage area. Materials are currently still stored in the pole barn. TMI is deciding <br />the final disposition of the pole bam and fencing. <br />Reve eg tation: Mine site is already greening up and grasses are beginning new growth. The growing <br />season appears to be starting early this year. Areas planted in fa112003 do not appear to have much <br />emergence yet. Seeds should remain dormant for a while longer.
