COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This processing and loadout site has been <br />inactive since June 2001 after the closure of the Lorencito Mine (#C-96-084). A proposed <br />decision to approve transfer of the permit from Picketwire Processing to New Elk Coal <br />Company was issued on March 21.2007 and is in the 30 day public comment period. <br />Ground conditions on this day were dry and the weather was mild. <br />Availability of Records <br />The public copy of the mine records ~s kept at the office of Peak Pro)ect Management (PPM). <br />The contact. address, and phone number for PPM is Ron Thompson, Peak Protect <br />Management. 34115 County Road 20.8, Trinidad. CO 81082. 719-846-4975. Records were <br />found in compliance as detailed on page 2a of this report <br />Hydrologic Balance <br />Pond 7 held slightly more water than observed during the last inspection but was still below <br />the lowest discharge hole on the primary riser and the outlet gate was closed Pond 8 held <br />water some two-three feet below the crest of the primary discharge user. Pond 4 held a <br />small amount of water in the southeast corner All of the existing ponds appeared stable with <br />no sign of damage or embankment problems <br />The operator is beginning construction of a new mine water discharge pond as approved <br />under Technical Revision No 49 (TR-49> Actwit,es to this point have been related to <br />moving any coal materials from the area and beginning to excavate a keyway for <br />embankment construction. Arrows on the photo below show the pond location. <br />The three containments at the Highway 12/RDA conveyor intersection were dry as were the <br />two containments at the West Mine. Diversion ditches paralleling the Purgatoire River were <br />also traversed and found in good condition, Road ditches near the entrance have been <br />
