:- "~ '; <br />GRAND MESA COAL COMPANY <br />717.14 BackfillinQ and Gradin <br />The small canyon area has both abandoned underground workings and <br />old strip pits where the coal outcrop was mined. Coal slack as <br />much as 20 feet deep, covers parts of the canyon floor including <br />the drainage. The operator proposes to use the old strip pits <br />for disposal of waste material and coal refuse and eventually <br />reclaim parts of the old mines. The State MLR division will have <br />to approve this in the permit before i[ can begin. <br />717.15 Disposal of Spoil and Waste <br />Presently there is no significant amount of spoil and waste, <br />although this may change as the operations develop. As mentioned <br />above, a disposal site has been applied for in the new State <br />permit application. <br />717.16 Topsoil Handling <br />Most of the mining area was previously disturbed by the Belden <br />operation. Some areas of new disturbance particularly in ll2 <br />portal area and areas whet'e diCChes and the sediment pond are <br />to be built, must have topsoil salvaged before any further <br />surface disturbance occurs. No topsoil salvage could be <br />inspected because of heavy snow cover. <br />717. L7 Water Quality Standards and Effluent Limitations <br />The mine does not have a sediment control system in place. A <br />Notice of Violation (79-V-5-13) was issued on June 21, 1979 <br />for this violation. The operator attempted to abate the NOV <br />by submitting a plan to the State MLR division in fall of 1979. <br />The plan was rejected by the State as inadequate and thus the <br />operator could not build the sediment facilities as required. <br />A second notice of violation 80-5-18-9, 111 was issued on this <br />inspection for the operators continued failure to submit an <br />adequate plan Co the State and for the failure to have sediment <br />control systems in place. The operator was advised that the OSt1 <br />Interim Regulations have been in full force and effect since <br />May 3, 1978. The previous NOV (79-V-5-13) was terminated February <br />20, 1980. <br />The new notice of violation requires the sediment control plan to <br />be resubmitted to the State MLR within 2l days and for all the <br />features to be constructed within 90 days of the State approval. <br />The operator has been told several times that failure to follow <br />abatement procedures will definitely result in a Cessation Order. <br />7 Yru.
