III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />completed sediment ponds, the original sediment pond and its collection ditches and silt fence at <br />the down gradient end of the disturbed azea. The mine ID sign was up. <br />There was no activity at the west mine fan azea. The sediment control consists of silt fence. One <br />section of silt fence, on the north end of the site, will need repair soon. The mine ID sign was up, <br />as was the topsoil stockpile sign. There were no gullies on the topsoil pile. <br />There were no problems at the Stevens gulch well field. The mine Id sign and surface <br />disturbance mazkers were up. There was no erosional gullying on the topsoil stockpile. The <br />topsoil pile sign was up. <br />East Mine <br />The operator has begun reclamation efforts at the fan area. At the remaining benches, all of the <br />structures have been removed, except for the concrete lined bottom of the surge bin and the <br />concrete foundations and pads. Several small rock falls into collection ditches need to be dealt <br />with fairly soon, although the ditches remain functional for now. Culverfs aze cleaz and straw <br />bales aze in place. <br />The operator has spread subsoil material over the west side of the newly placed run-of--mine <br />material at the west ridge waste pile. The east side of the new addition remains uncovered. <br />Collection and diversion ditches were functional. The pond was dry. <br />Pond 1, 2, 3 and 4 were dry. Pond spillways were functional. The bin walls of the ponds <br />appeazed to be stable. Pond inslopes were also stable. <br />The operator was continuing to screen coal at the run-of-mine-pile. There were no problems with <br />fugitive dust. The pond was dry and the culverts and ditches were functional. <br />Surface disturbance mazkers were up azound the mine site.
