III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />The inspection and the facts or evidence supporting the enforcement action. <br />This complete inspection was conducted by Joe Dudash of the Colorado DMG. No one <br />represented the operator during the field inspection. <br />Hiphway Coal Stockaile <br />There w2s no activity at the temporarily reclaimed site. The operator has placed roof bolts in a <br />pattern on a portion of the flat azea, presumably for mine safety training. The pond was dry and <br />the pond pump hose and pipe were set up properly. Straw bales were up along the railroad tracks. <br />The matting on the steeper slopes is functional. However, no vegetation has come up yet. There <br />were no erosional gullies on the disturbed area. There were two minor problems. The mine ]D <br />sign and post need to be put back into position, rather than just lying on the ground. Also, <br />another straw bale at the inlet to the clean water culvert that is located on the west side, next to <br />the tracks, would be. a good idea. <br />Train Loadout <br />A unit train had been loaded eazlier in the day and pulled out just before the inspection. During <br />the inspection, coal haul trucks were unloading. Although there were no problems with fugitive <br />dust on the highway, the highway has been somewhat blackened by the truck traffic. The <br />operator has placed dirt berms on both sides of the entrance roads to the Loadout. The roads were <br />in good condition. <br />The sediment pond was dry. The spillways were functional. The upland diversion ditch and <br />culverts above the pond were functional. Culverts and ditches were also functional. However, the <br />open junction of the two clean water culverts just south of the railroad tracks could use better <br />protection, perhaps with some straw bales. Imgation water was flowing through the clean water <br />diversion system. <br />Mine ID signs were up, as were permit boundazy mazkers and the topsoil stockpile sign. <br />West Mine <br />The operator has resumed reclamation backfilling and grading work at the west mine. The <br />contractor is the same one doing the earthwork at the Bowie No. 2 Mine train Loadout project. <br />Earthwork at Bowie No. 2 has been suspended for now while new track is put in, so the <br />contractor is doing earthwork at Bowie No. 1.
