III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments inciude discussion.of observations made <br />daring the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill Bear represented <br />the operator. The area has had several recent snowfalls, including a light snowfall the night before the . <br />inspection. Accumulated snow on the ground was up to 8 inches deep. The operator is, in the middle of <br />a longwall move to the last D-seam panel. D-seam mining will be completed in March of 2005 and <br />longwall mining will begin in the B-seam shortly after that.. <br />Main Mine Site <br />The paved main haul road was in good condition, with the guard rail in place. Road ditches and <br />culverts were functional. The access road up to the water tank bench was snow covered but passable. <br />The outside road berm was in place. The light use road to Pond B was snow covered and frozen. <br />The water tank bench was snow covered. The operator has approval to construct a drill pad uphill from <br />the vent fan. Upon approval of a future revision, the operator will drill a pilot hole in order to raise- <br />bore anew vent shaft from the B-seam up to the D-seam. The bench's outside berm was in place. <br />Due to the longwall move, the coal stockpile on the D-seam portal bench was small in size. The <br />operator is continuing the construction of the conveyor beltline that will bring coal from the B-seam <br />portal bench up to the D-seam portal bench. There were no problems at the office/pazking lot area. The <br />fuel facility was in order, as was the material storage area. Surface disturbance markers were up, as <br />were the mine ID signs. New signs are on order to show the new name: Bowie Resources LLC. <br />The operator continues development mining in the B-seam. The portal bench outside berm was in <br />place. No problems were noted at the material storage area. The entire B-seam excess material storage <br />stockpile was covered in snow. No problems with stability were noted. Snow also covered the main <br />topsoil stockpile. Sediment control was in place, as were the topsoil stockpile signs. <br />There was a moderate amount of stockpiled coal at the base of the hill Nq problems with fugitive dust <br />were seen. There are several hot spots on the coal stockpile but the operator is dealing with them. No <br />problems were seen with any of the other facilities in this area. The wash plant complex is in full <br />operation. A small slump and a few small rills were seen in the new cut slope behind the wash plant. <br />The water/ice level in pond B was about l foot above the primary discharge tube. The gated valve was <br />closed. The pond inslopes and embankment were snow covered. The emergency spillway was <br />functional. <br />Coal Waste Stockpiles <br />The gob pile haul road from the main mine to the gob pile area was snow packed-but in good <br />condition. The road ditch and berm were functional. No problems were observed with the material <br />storage areas along the road. <br />
