111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />rock drains which have not been completed as of July 10, 1997, or which will be built after July <br />10, 1997, the operator has committed to placing a graded rock filter layer between the rock drain <br />boulders and the filter fabric, as described in the last paragraph of page 2 of Section one of <br />Volume VII of the permit application. For the rock drains which have not yet been completed, <br />such as the rock drain on the east side of the portal bench, the operator also committed to <br />removing any material from between the rock drain boulders before proceeding with the graded <br />rock filter layer. <br />On July 9, 1997, there was a trickle flow of water flowing from a seep located just below the <br />outlet of culvert C-C8. The trickle of water flowed into culvert C-C9 and came out the outlet side <br />of the same culvert. The next day, the trickle flowing into culvert C-C9 was less and no flow was <br />observed coming out of the same culvert. <br />The operator also committed to opening up any rock drain at its base, so that seep water would <br />not buildup within the rock drain. The procedure would involve placing a culvert into the base of <br />the rock drain boulders, covering the contact point, and at least five feet back of the contact <br />point, with gravel. A filter fabric would, then, be placed over the graveled area. The entire azea <br />would be covered by the road bed. <br />TOPSOIL <br />The operator stated that the two topsoil stockpiles just north of pond B, and the topsoil stockpile <br />just west of pond C, will be moved to the main topsoil stockpile. The move will occur within one <br />to two months. The main topsoil stockpile has a ditch and silt fence to protect it. The other, <br />smaller, topsoil stockpiles do not have such protection. No erosion has been observed at any of <br />these stockpiles so the Division will not request that any surrounding ditches be constructed at <br />this time. This assumes that these smaller topsoil stockpiles will be moved to the main topsoil <br />stockpile soon, before any erosion would take place. The lazger topsoil stockpile just north of <br />pond B needs a topsoil sign. The other topsoil stockpiles have signs. [t would be a good idea to <br />have several topsoil signs located at different points on the main topsoil stockpile, once all of the <br />topsoil is at that location. <br />2 <br />
