III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of Colorado DMG. Jim Pendleton of the <br />Division was also present to review geotechnical aspects at the mine site. Bill Bear represented <br />the operator. Larry Whitt, who is in charge of the construction activities at the mine site, was also <br />present. The mine site was dry. The construction of the surface facilities continues. <br />ROADS <br />The operator is continuing to construct the main haul road. Most of the haul road right-of--way <br />has been established. However, several road fills in the upper portion of the mine site still need to <br />be built up to complete the right-of-way. For now, the pre-existing road is being used in these <br />areas. The lower portions of the haul road are now being graveled for road base. Haul road berms <br />have not been established yet. Road watering was being done during the inspection. <br />The haul road side ditches were established at the bottom of the road embankments. Silt fence <br />was in place at the low point of each haul road ditch. None of the haul road outslopes have been <br />vegetated yet. The Division urges the operator to seed these outslopes before erosion starts. <br />It was observed that some dazk material had been deposited on the haul road fill embankments. <br />The dark material was not topsoil, but, rather, a dark subsoil and rock taken from the portal <br />bench excavation. <br />One of the Maxim personnel was on site, performing compaction testing on the road fill and road <br />bed. The Maxim facility is located in a trailer, next to the mine office trailer. The Maxim <br />representative stated that most of the compaction has been to specifications the first time. When <br />the compaction testing showed a problem, that particular area was reworked and re-tested until <br />acceptable. <br />ROCK DRAINS <br />The operator has constructed rock drains at those places along the haul road fill where water has <br />been encountered. The rock drain portions constructed and finished previous to July 10, 1997 <br />were built with the filter fabric placed directly on top of the rock drain boulders, as described in <br />the second paragraph of page 2 of Section one of Volume VII of the permit application. For those <br />
