III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the inspection Comments also describe any enforcement actions taken dunng the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Muimg, and Safety (DRMS>. This mine ~s in permanent cessation and <br />reclamation of most areas is complete. Ground conditions were dry and the weather was <br />seasonal for early fall. <br />Availability of Records <br />The public copy of the mine records ~s kept at the Energy Fuets Coal Company office in <br />Florence. All records were found current and in compliance. Ground water sampling for <br />2006 will take place this month as regwred by the approved plan. The required liability <br />insurance is in effect till October 1.2006 and will expire in six days. NPDES records should <br />be filed with the public copy of the records for the 2"' quarter of 2006. More details regarding <br />the records inspection can be found on page 2a of this report. <br />Signs and Markers <br />The mine identification sign was present and in compliance with Rule 4.02 and displayed the <br />information regwred by Rule 4 30 2 for mines in permanent cessation. Anew mine <br />identification sign has been established at the coal loadout in compliance with these Rules. <br />~-a <br />
