The possille violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted <br />on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />1. Three of the four fuel tanks located a[ the fuel storage area did not have spill prevention/spill containment controls. The existing <br />spill containment berm needs maintenance to ensure adequate containment volume. Spill containment structures were also absent <br />for the fuel transport trailer, located at the crusher operation, and for fluid containers located at the equilrment storage area. All <br />tanks located on site were inspected, none showed evidence of rupture or leaking. Fuels, lubricants and chemicals need to be <br />stored in a controlled manner, at a designated location, with adequate spill prevention and spill containment controls to ensure <br />spilt fuel or fluids not escape and degrade quality of surface and groundwater (Rules 3.1.6 and 3.1.711. <br />CORRECTIVE ACTION: Properly store all fuels and lubricants in a controlled manner. Provide adequate spill containment <br />structures for all liquid chemicals and/or petroleum products stored on site. <br />6/14/96 <br />PB or PV PB <br />TOPICISI HB <br />AT, , <br />Pursuant to Rule 4.2.1, DMG will review the amount of financial warranty required for the Thomas Pit. A detailed estimate of <br />the recalculated cost, based on the approved Reclamation Plan and conditions observed during the inspection, will be forthcoming. <br />CORRECTIVE ACTION: Pursuant to Rule 4.2.1121, should DMG review indicate that the current amount of financial warranty is <br />insufficient to perform reclamation, the operator shall have up to sixty 1601 days to post additional financial warranty from the <br />date of written notice of such insufficiency. If the operator disagrees with DMG notice to increase the financial warranty, DMG <br />shall schedule the matter for a hearing before the Board. <br />FUTURE <br />PB or PV PB <br />TOPICISI FN <br />3. DMG records indicate that operator may have changed from Animas Aggregates, Inc. to Mountain Gravr:l & Construction. Rule <br />1.12 states the requirements of permit transfers end succession of operators. Please find enclosed, TRANSFER OF MINERAL <br />RECLAMATION PERMIT AND SUCCESSION OF OPERATORS APPLICATION PACKAGE, to be completed and returned to DMG <br />for review and approval. <br />CORRECTIVE ACTION: Complete the enclosed forms and return to DMG for review and approval.
