• (Page 31 • <br />MINE ID # OR PROSPECTING ID # M-76-020 <br />INSPECTION DATE 3122/96 INSPECTOR'S INITIALS WHE <br />Material crusher was operating. Highway transport fuel trailer and generator truck were parked at the crusher operation. Fuel leak <br />from the transport fuel trailer was not observed. Fuel trd'il6t was not surrounded by spill prevention/spill containment structures. <br />Please provide adequate spill containment structures for all fuels, lubricants and/or chemicals stored on site, e.ufficient to ensure spilt <br />fluids not escape and degrade quantity or quality of surface aad groundwater (Rules 3.1.6 and 3.1.71. <br />Equipment stored within the bone yard included the following: <br />Three mixing cones from concrete trucks -one was 2/3 full of dried concrete; <br />Two large underground fluid storage tanks -empty; <br />Several fuel tanks -empty; <br />Twenty-seven 55-gallon drums -one contained fluid -spill containment structure not observed; <br />Fifteen automotive and equipment batteries -all batteries appeared intact, no leaking observed; and <br />One dozer - DB size. <br />Discarded fuel tanks and 55-gallon drums, stored on site, should be stored within a spill containment structure adequate to ensure <br />draining fluids not escape and degrade quantity and quality of surface and groundwater (Rules 3.1.6 .and 3.1.71. DMG will <br />recalculate the financial warranty, including the cost for disposing all discarded equipment stored on site, should the discarded <br />equipment remain on site. <br />Rule 4.2.1111 of the Construction Material Rules and Regulations of the Colorado Mined Land Reclamation Board, effective 1 /96, <br />requires that all financial warranties be set and maintained at a level which reflects the actual current cost of fulfilling the <br />requirements of the Reclamation Plan. DMG records indicate that the financial warranty for this operation has not been recalculated <br />in recent years. Pursuant to Rule 4.2.1, DMG will review the amount of financial warranty required for the'rhomas Pit. A detailed <br />estimate of the recalculated cost, based on the approved Reclamation Plan and conditions observed Burin{I the inspection will be <br />forthcoming. <br />Operator stated that the name of the operator has changed from Animas Aggregates to Mountain Gravel f~ Construction.
