Pursuant to Rule 1.4.1(8), the Division has <br />determined the application contains deficiencies which prevent it from being considered filed for review. Please <br />respond to this Notice of Filing Deficiencies with the requested information and summarize each response to the <br />numbered items below, in a cover letter titled “Response to Notice of Filing Deficiencies, M-2025-062”. <br /> <br />GENERAL & APPLICATION FORM <br /> <br />1. The responses to Question 3 - Permitted Acreage and Question 3.1 - Change In Acreage (both on Page 1 of the <br />application form) are listed incorrectly. Please revise these fields to indicate 56.9 acres to be permitted 0 change <br />in acreage. The Division utilizes this same form for existing permits that propose expansions whereas Question <br />3.1 would show the expansion size. <br /> <br />2. The application packet did not contain an application fee (Question 4.1 - New Application, Page 1). As required <br />by C.R.S. 34-32.5-125(a)(IV), please submit an application fee in the amount of $2,696.00 made payable to the <br />Colorado Division of Reclamation, Mining and Safety or the Colorado Mined Land Reclamation Board. <br /> <br />3. On Page 5 and 6 of the application form, each responsibility under the Responsibility as a Permittee was not <br />initial. Please read and initial each responsibility. Please note, responsibility #10 will likely be left blank as the <br />operator appears to not be a joint venture/partnership. <br /> <br />4. Proof of posting the on-site notice(s) was provided in the application materials, however, the copy of the posted <br />notice does not contain the phone number of the Applicant as required by Rule 1.6.2(1)(b). Please provide proof <br />that the copy of the posted notice has been revised with the Applicant’s phone number or replaced with a <br />completed notice. <br /> <br />EXHIBIT N – Source of Legal Right to Enter (Rule 6.4.14) <br /> <br />5. Exhibit N includes a statement that the Applicant owns all properties associated with the proposed permit area. <br />As required by Rule 6.4.14, please submit documentation (deed, abstract of title, a current tax receipt) showing <br />the Applicant is the Owner of Record for the surface and mineral rights of the proposed permitted area. <br /> <br /> <br />
