Within the Mine Plan, you discuss the Division’s rules regarding activity requirements, temporary cessation, <br />and state that the operation is not intended to be an intermittent operation. Based on the proposed permit <br />materials and the Division’s familiarity with similar nearby operations, the Division believes this permit <br />should state that the affected lands could be used for less than 180 days per year. Additionally, based on the <br />seasonal restrictions set by the United States Forest Service (USFS), the permit should state the operation <br />may be considered intermittent. Please make changes to Exhibit C as necessary. <br /> <br />6. Within the Mine and Reclamation Plans, you state the maximum depth of a pit will be 20 feet and that no <br />more than 500 cubic yards of material will need to be backfilled at any one time. You also commit to not <br />opening more than 2 pits at any one time. This means at no point during the mining operation under the <br />current bond amount, a pit that is excavated to the maximum allowed depth will not exceed an area of <br />approximately 25’ x 25’ and when 2 pits are open, the depth, area, or a combination of the two will need to <br />be reduced accordingly. Please confirm the depth and volume commitments. <br /> <br />7. Under the 6.3.3(1)(e) heading, the mine plan states Sites A & B are in close proximity to one another and <br />may eventually join depending on size and direction of the pegmatites. Please confirm this statement as <br />Sites B & C are closer in proximity than Sites A & B. Furthermore, please expand this statement to clarify <br />that a permit amendment will be submitted in the future to address this potential expansion and will be <br />approved prior to joining the two dig sites. <br /> <br />8. Please discuss if and how fuel, oil, and other petroleum products will be stored on-site for the operation. <br /> <br />9. The Division will calculate a reclamation bond cost estimate based on the responses to this adequacy <br />letter. The Forest Service will be provided with a copy of this estimate to review it for sufficiency. You will <br />be provided with a copy of the reclamation cost estimate for review before the decision date. <br />No response needed. <br /> <br />EXHIBIT D - Reclamation Plan (Rule 6.3.4) <br /> <br />10. The Reclamation Plan includes a seed mixture with a list of species, species percentages, and species <br />seeding rate. At a proposed 40 lbs./acre seeding rate, the Division has determined this seed mixture will <br />have over 500 seeds/square-foot which is substantially high, even for broadcast seeding. Please provide a <br />technical justification which supports this seeding rate or propose a more appropriate seeding rate. <br /> <br />EXHIBIT E - Map (Rule 6.3.5) <br /> <br />11. Please provide the latitude and longitude coordinates of the permit boundary corners for Site A, B, and C on <br />one of the Exhibit E Mine Plan Maps or as a separate table. <br /> <br /> EXHIBIT F - List of Other Permits and Licenses Required (Rule 6.3.6) <br /> <br />12. As the proposed operation is located on USFS lands and the USFS has conditionally approved your Mine <br />Plan of Operations (MPO), there may now be discrepancies between the USFS MPO and the 110(1) <br />permit application following the Division’s technical review and your subsequent adequacy review <br />responses. Please commit to informing the USFS of any revisions to your proposed operation once the <br />Division approves your application. <br />
