The Division is required to make a decision on the permit application no later than January 15, <br />2026; therefore, a response to the following adequacy review items should be submitted to the Division as <br />soon as possible. Please respond to this letter with the requested information and summarize each response to the <br />numbered items below, in a cover letter titled “Adequacy Review Response, M-2025-038”. The Division requests <br />that the responses are submitted no later than 3 working days prior to the decision date deadline (January 12th); if <br />more time is needed to complete the response, the Division can grant an extension to the decision date deadline <br />following your request, prior to the deadline, for additional time. <br /> <br />GENERAL APPLICATION PROCEDURES <br /> <br />1. As required by Rule 1.6.2(1)(d), please submit proof of publication in a newspaper of general circulation <br />in the locality of the proposed mining operation. <br /> <br />2. As required by Rule 1.6.2(1)(e), please submit Proof of Notice (return receipts of a Certified Mailing or <br />proof of personal service) of the notice(s) sent to: <br />a. all owners of record of the surface of the affected land, <br />b. all owners of record of the mineral rights of the affected land, and <br />c. all owners of record of the surface within 200 feet of the affected land boundary <br /> <br />3. To date, the Division has received comments from Colorado Parks & Wildlife on the permit application. <br />The letter is attached for your review. Please acknowledge and address any comments noted in the letter <br />and make changes to the application as necessary. <br /> <br />EXHIBIT B - Site Description (Rule 6.3.2) <br /> <br />4. Within Exhibit B, you have provided a Web Soil Survey soil map which shows the area of the proposed <br />dig sites in Park County as NOTCOM (No Digital Data Available) and the adjacent area within Teller <br />County as 46 (Sphinx-Rock outcrop complex). The Division has been able to use Web Soil Survey to <br />indicate the area of the dig sites are 794M (Sphinx family). Please resubmit a Web Soil Survey soil map <br />which identifies the mapped soil units and provide the associated Report - Map Unit Description for each <br />soil unit. Please also approximate the location of the three sites and access route on the soil map. <br /> <br />
