November 19, 2025 C-2009-087/Peabody Sage Creek Mine NCG <br /> <br /> <br />Number of Partial Inspection this Fiscal Year: 0 <br />Number of Complete Inspections this Fiscal Year: 2 <br /> <br /> Page 3 of 9 <br /> <br /> <br />ROADS Rule 4.03 <br />Construction 4.03.1(3), 4.03.2(3); Drainage 4.03.1(4), 4.03.2(4); Surfacing and Maintenance 4.03.1(5) and (6) <br />4.03.2(5) and (6). <br />The gravel roads around the site appeared stable and in good condition at the time of inspection. Drainage ditches <br />are maintained to control stormwater. Some sediment loading was observed in the ditch that runs along Road <br />D, near the water tank. The operator will need to excavate the ditch in this area. <br /> <br />HYDROLOGIC BALANCE – Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Drainage- Acid and Toxic <br />Materials 4.05.8; Impoundments 4.05.6,4.05.9; Stream Buffer Zones 4.05.18. <br /> <br />The banks around the ponds and dam outslopes appeared stable and well vegetated at the time of inspection. No <br />seepage through the pond dams was observed at the time of inspection. Pond emergency spillways appeared to be <br />clear or excess vegetation and functioning adequately. The Division observed the following ponds during the <br />inspection: <br /> Pond 3 on the north end of the site was holding water and not discharging through the culvert at the time <br />of inspection. The vegetation around the discharge culvert and channel is maintained to allow flow. A few <br />new badger holes were noted on the top and north side of the dam (Photo 3). The operator will need <br />to fill the holes to ensure stability of the dam. <br /> Pond 2 in the center of the site was holding water and discharging clear water through the flume during <br />the inspection (Photo 4). <br /> Pecoco pond on the south end of the site was holding water (Photo 6). <br /> Upper and lower sumps were holding water during the inspection (Photos 7-8). <br /> <br />TOPSOIL— Rule 4.06 Removal 4.06.2; Substitute Materials 4. 06.4( 4); Storage and Protection 4. 06. 3; <br />Redistribution 4. 06.4: <br /> One large topsoil stockpile is located adjacent to the Pecoco pond. The pile appears stable, well vegetated <br />and undisturbed. <br /> <br />SLIDES and OTHER DAMAGE- Rule 4.12 <br /> No areas of instability, slumping or sliding were noted at the time of inspection. <br /> <br />FISH and WILDLIFE– RULE 4.18 <br /> No wildlife was noted on site during the inspection. <br /> <br />INSPECTION, ENFORCEMENT and CIVIL PENALTIES – RULE 5 <br />Inspections 5.02; Availability of Records <br /> Records were reviewed at the Peabody Mine office.
