6. The Division conducted an inspection on July 18, 2025, and confirmed <br /> that the Operator was now in compliance. The inspection report, dated August 18, <br /> 2025, was sent to the Operator with a Notice of Completeness regarding the request <br /> for a second period of Temporary Cessation. <br /> 7. On August 18, 2025, the Division provided notice of the Operator's <br /> request for a second period of Temporary Cessation to the Clear Creek County <br /> Board of Commissioners and the City of Idaho Springs. The Division did not receive <br /> comments or objections in response. <br /> 8. Operator's notice demonstrates a commitment to conduct mining <br /> operations by the end of the second period of Temporary Cessation and has outlined <br /> measures to be taken to comply with performance standards while the mine is in <br /> Temporary Cessation. Operator's request also acknowledges the 10 consecutive <br /> year limit on Temporary Cessation and demonstrates that the existing financial <br /> warranty is adequate. <br /> CONCLUSIONS OF LAW <br /> 9. The Board has jurisdiction over this matter pursuant to the Mined <br /> Land Reclamation Act, Article 32 of Title 34, C.R.S. ("Act"). <br /> 10. Under section 34-32-103(6)(a), C.R.S., an operator may temporarily <br /> cease production upon compliance with the requirements therein. <br /> 11. Rule 1.13.5(3) of the Mineral Rules and Regulations of the Colorado <br /> Mined Land Reclamation Board ("Rules") requires a notice for a second period of <br /> Temporary Cessation to include an explanation as to why operations have not <br /> recommenced or reclamation begun, a demonstration of commitment to conduct <br /> mining prior to the end of the second period, measures to be taken to comply with <br /> reclamation requirements or other performance standards while the mine is in <br /> temporary cessation, demonstration that the financial warranty is adequate, and an <br /> acknowledgment of the 10-year consecutive limit for non-production and temporary <br /> cessation of mining activities. Operator has provided the required information in <br /> its notice for a second period of Temporary Cessation. <br /> 12. Operator complied with the requirements for a second period of <br /> Temporary Cessation as set forth in the Act and Rules. <br /> ORDER <br /> Based on the foregoing findings of fact and conclusions of law, the Board <br /> hereby GRANTS the second period of Temporary Cessation submitted by Venture <br /> Resources, Inc.
