*1 – There was a discrepancy identified in the acreages approved for Phase II release documented for SL5. The SL5 August 27, 2014, Findings
Document found 800.9 acres were eligible for Phase II bond release. However, the Division’s Proposed Decision Form and database incorrectly
documented 800.8 acres were released. This is corrected with this SL8 Findings Document.
*2 – Pond 009 was included in the SL7 Phase Bond Release Application, this area accounted for 2.89 acres of disturbance. Pond 009 is a
permanent impoundment and was approved to remain in place post-mining. DRMS approved this area for Phase III bond release with SL7.
However, this area has not received Phase II bond release previously, therefore was not included in the SL7 Phase II bond release acreage total.
This is corrected with this SL8 Findings Document.
*3 - Approximately 1,291.5 acres have been reported to have been affected at the site. With the approval of SL8, the total cumulative Phase I
release area will be 1,291.5 acres, Phase II will be 1,291.19 acres, and Phase III will be 1,291.5 acres. The .31-acre discrepancy of Phase II
acreage is likely due to rounding differences in parcel acreages and tracking.

The application was received by the Division on 9 October 2024. The application was deemed complete on 16
October 2024. SPL published notice of the bond release application in Colorado Mountain News Media
Steamboat Pilot once weekly for four consecutive weeks, beginning 11 September 2024. SPL also notified
landowners within and adjacent to the mine permit area, and other interested parties of the application for bond
release, as required by Rule 3.03.2(1). No comments, written objections, or requests for an informal conference
regarding the bond release application were received by the Division.

The Division scheduled and conducted a bond release inspection on 5 June 2025. The site inspection was
conducted in accordance with Rule 3.03.2(2). The Division notified the operator, surface owners, Bureau of
Land Management (BLM), the Office of Surface Mining Reclamation and Enforcement (OSMRE), and the
Colorado State Land Board of the inspection via certified mail. Attendees included:
