The SL5 August 27, 2014, Findings <br />Document found 800.9 acres were eligible for Phase II bond release. However, the Division’s Proposed Decision Form and database incorrectly <br />documented 800.8 acres were released. This is corrected with this SL8 Findings Document. <br />*2 – Pond 009 was included in the SL7 Phase Bond Release Application, this area accounted for 2.89 acres of disturbance. Pond 009 is a <br />permanent impoundment and was approved to remain in place post-mining. DRMS approved this area for Phase III bond release with SL7. <br />However, this area has not received Phase II bond release previously, therefore was not included in the SL7 Phase II bond release acreage total. <br />This is corrected with this SL8 Findings Document. <br />*3 - Approximately 1,291.5 acres have been reported to have been affected at the site. With the approval of SL8, the total cumulative Phase I <br />release area will be 1,291.5 acres, Phase II will be 1,291.19 acres, and Phase III will be 1,291.5 acres. The .31-acre discrepancy of Phase II <br />acreage is likely due to rounding differences in parcel acreages and tracking. <br /> <br />The application was received by the Division on 9 October 2024. The application was deemed complete on 16 <br />October 2024. SPL published notice of the bond release application in Colorado Mountain News Media <br />Steamboat Pilot once weekly for four consecutive weeks, beginning 11 September 2024. SPL also notified <br />landowners within and adjacent to the mine permit area, and other interested parties of the application for bond <br />release, as required by Rule 3.03.2(1). No comments, written objections, or requests for an informal conference <br />regarding the bond release application were received by the Division. <br /> <br />The Division scheduled and conducted a bond release inspection on 5 June 2025. The site inspection was <br />conducted in accordance with Rule 3.03.2(2). The Division notified the operator, surface owners, Bureau of <br />Land Management (BLM), the Office of Surface Mining Reclamation and Enforcement (OSMRE), and the <br />Colorado State Land Board of the inspection via certified mail.
