SOURCE OF LEGAL RIGHT TO ENTER <br /> THIS AGREEMENT, made this /Zth day of August, 2025, by and between <br /> Asphalt Constructors, Inc., a Colorado Corporation, hereinafter referred to as ACI (First <br /> Party) and Blanca Potato, LLC hereinafter referred to as Property Owner(Second <br /> Party) <br /> WITNESSETH That in consideration of the mutual covenants and agreements to <br /> be kept and performed on the part of said parties hereto, respectively as herein stated, <br /> the said parties hereby covenant and agree that they shall: <br /> 1. ACI has executed an agreement with the Royalty Owners of said property to <br /> allow for mining, extraction, and removal of sand and gravel materials from <br /> the property. <br /> 2. Physical description of the area is located all in Sec 20, T 30S, R 72W. 6th <br /> Colorado Prime Meridian more particularly described as follows: <br /> BEGINNING AT A POINT on the West Right-of-Way Line of Costilla <br /> County Road 18, whence the East '/4 Corner of Said Section 20 bears <br /> S89°57'00"E, a distance of 27.30 feet; THENCE along said West Right-of- <br /> Way Line S01°02'18"W, a distance of 932.24 feet to a point; THENCE <br /> N89°51'52"W, a distance of 2,658.33 feet to the North-South Centerline of <br /> Said Section 20; THENCE N00°41'01"E, along said North-South <br /> Centerline of Said Section 20, 1,699.62 feet to a point; THENCE along a <br /> non-tangent curve to the right, said curve having an arc length of 763.37 <br /> feet, a radius of 1563.49 feet, a delta angle of 27°58'28", a chord bearing <br /> of N64°29'33"E, and a chord length of 755.81 feet; THENCE N45°01'21"E <br /> a distance of 343.11 feet to the South Right-of-Way Line of Costilla <br /> County Road HH; THENCE S83°11'36"W along said South Right-of-Way <br /> Line a distance of 269.87 feet to a point; THENCE S82°52'39"E, <br /> continuing along said South Right-of-Way Line, a distance of 1,324.69 feet <br /> to a point; THENCE S82°21'56"E, continuing along said South Right-of- <br /> Way Line, a distance of 146.85 feet to the West Right-of-Way Line of <br /> Costilla County Road 18; THENCE SOO°06'25"E, along said West Right- <br /> of-Way Line, a distance of 1,125.95 feet to the POINT AND PLACE OF <br /> BEGINNING, containing 127.86 acres more or less. <br /> 3. ACI agrees to maintain insurance on all operations. Certificates of Insurance <br /> with Owner included as additional insured to be furnished to Owner upon <br /> request. <br /> 4 ACI to maintain all permits as required to conduct the sand and gravel <br /> extraction in accordance with all governing agencies with the State of <br /> Colorado. <br />
