For all wells included in this SWSP, the Applicant shall ensure that all well permit <br /> file(s) are complete and valid and the uses proposed for the well(s) in this SWSP <br /> are consistent with the decreed and permitted uses, including permit no. <br /> 77837-F. If well permit(s) for any of the wells do not meet this standard, the <br /> permit files must be completed or valid well permits must be obtained prior to <br /> expiration of this SWSP. Should an additional SWSP be requested, the Applicant <br /> shall demonstrate that this requirement has been satisfied. The provisions of <br /> section 37-90-137(2), C.R.S., prohibit the issuance of a permit for a well to be <br /> located within 600 feet of any existing well, unless the State Engineer finds that <br /> circumstances so warrant after a hearing in accordance with the procedural <br /> rules in 2 CCR 402-5. The hearing will be waived if the Applicant is able to <br /> obtain statements from the owners of all wells within 600 feet, verifying that <br /> they have no objection to use of the proposed well must be obtained. <br /> 6. Replacement water is to be supplied from the Ouray Ditch and Ridgway Reservoir <br /> during the irrigation season and from Blue Mesa Reservoir for the non-irrigation <br /> season, which will be released/delivered according to the schedule included in <br /> Tables 3 and 4 of this SWSP, subject to assessment and modification by the <br /> Division Engineer or Water Commissioner. <br /> 7. Conveyance loss for delivery of augmentation water is subject to assessment and <br /> modification as determined by the Division Engineer depending upon current <br /> conditions. <br /> 8. Replacement water shall be made available to cover all out-of-priority <br /> depletions in time, place and amount and shall be made available under the <br /> direction and/or approval of the Water Commissioner. The replacement water <br /> that is the subject of this plan cannot be sold or leased to any other entity. As a <br /> condition of subsequent renewals of this SWSP, the replacement water must be <br />
